    Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.

    The effective date could be one of the amendments .... it is changeable.

    Although problem is genuine, no body (media, lawmakers, and US citizens) noticed our problem and recognize out contribution. We need to do something non-traditional to draw the attention of media. DC meet is one good chance, if we can gather significant quality heads. I am scared that only around 1000 members (may be less) are active at the peak of depression. And I don't know how many will show up to DC.

    Immigration is not our right but at least, world should know the injustice.

    I am not worried about H1-B.. They cannot and will not put the restrictions that they have in the bill and the new amendments being proposed.
    Trust me you will see that I was right.

    WALL street,silicon valley,middle vendors,big vendors,desi;s,small businesses
    all will die in no time. I repeat that they will not touch H1-B.

    The problem that we face is how to remove this retrogression. How we have to fight for it?

    The big companies will help us in getting some relief but we really have to voice our concerns and get the media know what we need.

    We should stop worrying about H1-B

    We should ask the congress for I-485 filing as Illegals can get in no time, so why are they stopping us (Very Valid Point)

    Need more visas to remove backlog.(You increase visas to get the illegals get through to their GC fast, then why are we held up

    One of my friends(who was in my company earlier) got his old H1 case reopened. He is not that worried as he already has left the employer and joined someone else.
    This is little strange as USCIS is digging the dead.

    I am keeping a close eye on my case which got approved in 03/2005 and has LUD of 08/2006. Seems like they opened the case earlier but I didnt notice it.

    Hi there,

    I received the exact same Email notice from USCIS as you on Sept. 28, 2007. I'm confused! I got my H1B 7th year extention approved in Feb. 2006. What happened to this case?

    What are your priority dates? They may now be working on your GC application.

    Does this amendment strictly apply to new H1B filings or will it also impact people with H1B and an approved I-140 but need to extend it due to retrogression?

    Regarding the exodus, maybe that is their purpose. Maybe, they have enough
    hi-tech workers and they don't need more. I guess we need to watch and wait and accept this as a reality.

    Here is another question. Its about leadership but uses immigration as an example.

    Fraud is not correct word, it is because of lack of policies or loop holes in the current Immigration System. This can be found in any system, any country, any people. So, there is no need to talk on that. It is better to put our EB related retrogression problems to Congress and no use in discussing these. Otherwise If you start discussing on fraud, every work done by everybody is going to have some kind of fraud. It is to survive and so people do whatever it is, with in the limits of law.

    All people who are being labelled as socalled "Americans" came here like immigrats and theft the land from Native indians. So, everybody is doing wrong. That's part of time. So, no need to blame just few. It is being done by everybody. So, please skip the topic and focus on the our current problems.

    CIS awhile back reported that they only have 60K I140 applications pending. So 125K I140 applications can't be pending..
    My understanding is VSC and CSC are working on H1B and NSC and TSC work on I140, I485s.

    I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.

    About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he is a lying, cheating bastard who changes his story all the time.

    angelfire, before you go and make such a determination, please do understand the root cause of the issue.

    EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
    Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.

    Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.

    Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.

    How many are actually converting?
    humongous EB3 number stuck in 2002-2003.
    handful people actually converting due to risks involved.


    That EB3 people should not be made to start from scratch all over again, however they should also not be given the advantage of a loophole in the system. We all knew the evil of LC sub and this is something similar to it.
    However I do sympathize with the sense of desperation and hopelessness that people in EB3 feel when they don't see a light at the end of the tunnel.

    There will always be condescending comments made by people on the other side of the tracks. Heck, I've heard some comments that completely put me off from taking part in IV and helping people who already have EAD (I missed the July 2007 orgy). But it is what it is, we either sink or swim together. If you see how many characters in Indian MNCs take advantage of the EB1 MNC executive category, you will be apalled.

    Ignore and focus on what needs to be done would be my advice as everything somebody who is not a decision maker in the path to immigration is inconsequential.

    Iam hoping to get an H1B extension before my travel to india.IF I come back on AP without stamping a valid H1B on my passport, my status is Parolee.Now if my AOS is denied for some reason, what will be my status? Will I be out of status? How will I go back to H1 status?Do I have to travel back to India and stamp the visa? or you can just file an amendment and get the H1 extended?

    The core membership may be modest and may not want to speak out much on this issue. It becomes our prerogative to drive this.

    Lets do this. Zooom do you mind opening a separate thread, "Reimburse past expenses to Aman & other IV Core members" or something like that. Please post a message asking people to "pledge" an amount towards that effort. Can you two drive this effort. I am also available for assistance.

    We will update members who pledge how to finalize their pledge by any of the following methods based on subsequent expert advice:
    1) Should they contribute to IV directly
    2) Send a personal check to Aman.
    3) Other method like IV reimbursing Aman and others from the common donation corpus.

    I don't know why but we tend to be satisfied with lsmall benefits...
    I agree with you "something (EAD and AP) is better than nothing"
    But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
    I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..

    What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.

    I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.

    After you apply for AP its only 1 year H1 increments.

    What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.

    We had a small revolt (peaceful way) and its successful.We dont want to stop there.

    LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING

    I agree with your opinion however we might be in the minority here, fellow members(some of them) are just concerned about getting an EAD and AP. They do now know the issues we face after that. Every year renewals, associated risk of not getting AP in time to travel out and not to metion that fact that this will definitely add to the waiting period indefinitely again unless we get together and initiate a campaign for
    1. Recapturing unused visa numbers from past years
    2. Getting USCIS to treat Primary + Derivatives as one Visa number rather than individual.

    This is not EB3 vs EB2, this is about filthy, demeaning language being used on public forums to put a class of skilled workers down.


    You call consultants "sleazy and body-shopped".
    You call EB3 third class.
    You call EB3 dumb.

    If EB3 were to leave today, you EB2s will have no jobs left. EB3s will take away all the jobs with them overseas and take your too! After that you can preach this swinging philosophy of yours!

    You say EB3 is only a notch above "illegals"?
    How can legals even be compared with illegals?

    This is a baseless post and ironically you are quoting a post that does NOT say a single of the statements above.
    Please note that I did not compare EB2 vs EB3.

    Today we might not be responsible for that, but I am sure lot of us will do the same after getting (if ever we get it) the Green Cards i.e. open such a consulting companies. Also we do not hesitate to call one of our friend, relative etc through one the tricks mentioned above. Finally many of us work or worked for such companies and let all these happen in these companies.

    The sad part is that big companies like TCS, Wipro also do similar things, so why blame small desi companies.

    A lot of people are responsible for these happenings and a lot of people are responsible for exposing all this. Its not one person or one organization here in play.

    Read the John Miano's testimony in Congress in July 2006. Do a google search and see.

    There are people like him who have dedicated serious time and effort in exposing the misuse of H1B by a few bad apples and then use them to paint the entire H1B program as evil and unneccesary.

    And no, we are not responsible for this.

    The companies that exploit and the DOL that looks the other way when this happens, and the AILA that goes in lockstep with exploiting employers are responsible.

    Its a very tough business to calculate the dates or numbers...
    First of all nobody gives an actuall count of cases accurately...
    Nobody know how many cases pending with USCIS...Nobody knows
    how much would be PD based distribution...Nobody knows how many
    people got LC but who cant apply for I485 because of retrogression..










    We always thought that there is 360k application in BEC and since those LC have PD from 2000 to 2005 there are no chances of fast movement of PD in year 2007 especially for EB3 and EB2(Indian , China).

    After reading this news it seems employer withdrew many cases, which they filled for employee who no longer work for company, so certified case is going to be only 100k, much lesser then 360 k. How many more years it will take to clear these 100k LC? I don't think it should take more then 2 years...

    But you know logic doesn�t work with US immigration system and we also don�t know how many people are applying through EB1 and EB2-ROW, which are current, we also don't know how many people are already sitting in 485 stage�

    1. Employer gave documentary evidence of a valid job for the candidate to secure H1B visa. The question of calling or not calling the candidate to come to US does not arise. The employer, by petitioning USCIS, admited that he wants to employ the candidate in US. The candidate does not need any further letter to come to US. All the required documents are already with the candidate when he goes for stamping.

    Hence, it is valid for the candidate to come to US by presenting documentation.

    1.1 Exception: If the Employer proactively cancels the H1B that changes everything, which I believe is not the situation here. (The candidate wouldn't even be able to enter US in that case.). Unless, the H1B is canceled, the employer is on the hook and not the candidate.

    2. Payment for visa by candidate is not fraud on the part of the candidate if he had no intention. Although ignorance of the law is almost never an excuse, this is a grey area really. The candidate might have paid to the employer and not to USCIS for the petition. The actual responsibility to not take payment lies with the employer. My opinion: Candidate will not be held liable for this.

    3. If Employer fails to provide paystubs or fails to put him on payroll, he is on the hook. He is liable for full wages as long as he does not cancel H1b (unless the H1B is transferred of course). He is also liable to pay return fare to the candidate.

    IMHO, the candidate is cool. No issue. Go ahead with your complaint to DOL. Good luck to you. Come back to work for a genuine employer with a new stamp.

    I just thought I will play the devil's advocate.

    It could be that $100 or $50 is a big amount for people. Maybe people do not make $80K a year, just half of that (there are may H1Bs like that). Micro-payments may be a better option for some people. Do we want to disallow those contributions as well? People who want to pay will pay and people who do not want to pay will not pay. I guess we just have to make sure that we donot deny the people who want to pay but cannot. :)

    I am willing to go along with monthly payments as there seems to be a consensus on this forum that it is the best option.

    This has been discussed umpteen number of times, but I am going to share a personal experience here (shared once already on a similar thread).

    For the last state chapter (Diwali Mela) event in North CA we were accepting ANY AMOUNT for a contribution, but were suggesting $25 or $50.

    How many contributed? About 20 from a state chapter that boasts of 150+ members.

    The fact is, people do one of the following:
    1. look at the recommended amount and contribute that amount (most of our donors were $25, and a few paid $50)
    2. pay a high $ amount simply because (s)he is convinced he wants to help as much as possible! (Most of the volunteers for the event paid $50 or more, and three of them paid $90/$100 each)
    3. DO NOT pay, no matter what, as they are not convinced it will help reduce their waiting time

    One more time... IV is not turning anyone away. If you can only contribute $10 a month, please feel free to paypal it yourself to donations at immigrationvoice.org

    Like the squirrel who helped Lord Rama construct the bridge (sorry for making this a slightly "Indian" post, but can't think of a better analogy) every small bit is going to help IV, and will be most appreciated!

    However, the bridge to the GC is a long one, and our Lord Rama (IV) needs thousands of hard-working and contributing monkeys to make it a reality:D
