I have been a long time passive audience in this joint and now I am voicing my opinion with a logical and polite discussion. What's with the god forgiving my ignorance, if any?
Ok here is my question how come all EB3 are "body shopped consulants" and what are EB2 ? "High profiled consulatants" ? I want to know what is gctest ?

Exactly.. You apply now.. no way it is going to get approved in time.. substitution approval takes anywhere between 4 months to 1 yr. Most common I heard is 6 months. you try to slide just under the door.. they aren't going to be happy abt it..

Did you even read my post and the pdf link. BTW, pdf link refers to Aug 21st, 2009 much before this memo came out. Even if memo is withdrawn, how that is going to change the points agreed by the court?

This memo does not make any difference that way. Like I said before, this memo just make the interpretation public knowledge.
Why these H-1B cases have been denied in last years and why these denials were not reversed by appeal court? These answers should enlighten you.

Regarding the date of PDF (Aug 2009), USCIS has already been practicing whatever is listed in the Jan 2009 memo for past 1.5 years. The above said decision (PDF) was made during that duration. AILA is contending the very arguments made in Aug 2009 pdf.
Also on another note, one of the leading lawyer's client reported that he got his H1B approved for a multi-layered consulting situation without even a client letter. So it depends on the lawyer who is presenting the case.
Anyways let us wait and see.

You are missing the point and no i am not kidding. i know you guys are angry that people are not contributing( i am monthly). People have money but they dont care they want a free ride, you cant put your hand in their pocket and amke them pay. The point i am trying make is that instead of complaining we can try and do something positive. There are many ways of contributing.
Getting contributions is always depressing. people will listen but the like watching from the side lines. If have knocked many doors people listen, few act, thats human nature. They like to support winners not strugglers. if you look at the funding patterns of other groups you will find out that they are being funded in a big way by companies or a couple wealthy individuals with an agenda. We on the other hand consist of people who are directly affected by retrogression. Sadly, once (many) deisis get their GC's or become sucessful they wouldnt spend 10cents on our efforts.
i took a couple of days of during the december debacle and called each senator in the list. i email any and every one i know, nothing happened, i felt helpless for a couple of days, then got back to normal.
My IM has a header/identifier that mentions IV, if you have a 50 odd people from your office etc on your IM i am sure 15-20 might visit the the site and a few might even join in. Most of them will ask you about IV. If each one of us can do something little, maybe something positive might happen and most of all the core team can worry about the big picture instead of monitoring threads or provided updates every hour and foucs on their long term efforts.
What is not productive is bitching and moaning about issues like who caused, the mess, how desis screw up and the like....

That shows the resolve of this community to get any kind of relief yet we all complain why illegals get preferential treatment. Because they are vocal and determined to get some relief. They come out in large numbers all over the country to protest and make their voices heard and here we can hardly find anyone willing to tell their story to the media.
In conclusion, it's not that we don't have the money .. we are not willing to contribute and are too busy questioning IV's motive and financials. We would rather pay 20k for sub labor than 20 dollar for IV and this is the attitude which will take us no where in terms of any relief for legal community. God help us all.

Now we have poll results. What does these number mean to us? Any action item?
All this poll proves is that new EB3 folks are more vocal. If we really need an action item then start supporting IV with money. Take part in IV action items to call reps.

How will it march steadily when we have less than 3000 numbers for the year?
I am sure we have many pplicants with PD in 2002 and 2003. I would be surprised if PD moves beyond April 2002 in FY 2009.

Nobody is complaining because everybody has the attitude, "Let somebody else do it, I will reap the benefits". It it the like, "Why should I pay IV when everybody else is paying it; I should just get free advice".
I & my colleague filed a complaint against our ex-employer early this year and the DOL W&H said they will work on our case in then next 3 months; they are currently working on cases filed in the last quarter of 2007. The reason why I filed a complaint was not because I need the money he owes me but because he exploits every employee and I wanted to bring him out in the open (will post the outcome once DOL does something about it). The fact is, as long as the employer knows he can get away with shit they will continue to break rules. Now that ICE is cracking down on er's hiring illegal immigrants you will see that er's will stop hiring them. I think the reason why we cannot get our much deserved provisions passed in the house and congress is because of the fact that today lots of US Citizens and Green Card holders are loosing their job to the people who are illegally present in the U.S. I don't beleive in shit, "Employer's cannot find U.S. workers". The fact is that employer's are not willing to pay workers the wages they deserve. Imagine one hour of Federal wage today after taxes will only get you 1 gallon of gas.
The employers are happier to hire illegals as they can pay them shit wages, they don't have to pay er's contribution of social security wages, no er's contribution of state taxes, no Medicare tax, no workers compensation. Just imagine wont we be annoyed if we can't find a job in India because Nepali or Bangladeshi (no disrespect to these countries) illegal migrants are talking our jobs away from us by working for lower wages.
Sorry for all this rant; I am tired of waiting for GC for the last eight years and am tired of people sitting on their dump xxx hoping somebody will fight for their cause and they will get to reap the benefit. Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle

I have been a IV member since 2006 . I have seen the ups/downs . donated money , sent letters , attended rallies and done whatever has been been proposed . But I see that many senior members who had the drive to motivate people are not sending or being part of any messages or threads at all and that is exactly why the movement seems to be losing steam .
The standard response that I see to any question is "have you donated money ? " . "Don't ask for anything till you have donated. " this is followed by some some red dots which normally works to silence the questions. People will be willing to donate when they believe in the movement . I remember we collected $ 30,000 in 1 month before the rally there was huge thread with all the donations . People were charged up and the money came up automatically . I am willing to donate but to be brutally honest I do not see the same level of motivation as was there in 2006 / 2007 days .Please use this as a wakeup call and not as reason to vent your frustration on me .
There are many senior members who I do not even see any more . Members joining in late 2007 or early 2008 will not know any of these guys .
Aman Kapoor . He is the founder of IV . I have not seen his messages since the past 3 years almost . Where is he ? Is it too much for him to send a greeting in New years eve motivating the members ? It takes just 2 minutes .

If you have a country where the prime minister shows his face only once in 4 years , how are the people supposed to believe in that movement ? Please don't reply with a message saying what have I done or why can't I contribute money ? I have done that I am looking for leadership to show us the way and motivate us . All campaigns don't need money donations( Letters , calls , faxes etc ) . We could start with that and then drum up support and momentum and then the money will start flowing in automatically . There has to be a synchronized campaign organized by the leadership and all I see is everybody putting their eggs in the basket called spillover.

Like many other technology forums, you need to be a paid member to see any premium content, else only part of the message is visible...that makes every one a paid member...we can have a similar setup to see a senior member post...that way every post from a senior members will generate revenue and in turn more money for lobbying!

Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?
Q.2) Q.1 raises Q.2. When the dates are no more current, is adding your spouse as a dependent on your 485 safe enuf for her to be considered for filing 485 and getting GC when the dates will be current in future.
