My H1B going to expire Jan 2008. I am not planning to renew it. My PD is current (india-eb2 2004 jan). I am planning to travel in March 2008. Do I can travel with AP, without valid H1B papers. ? Do I need to renew my H1B ?

You should have AP approved to travel in / out of USA, and valid EAD to work after your H1B expires (though you continue to work for the same employer). It is recommended to keep H1 status as long as you can, just in case anything happens to AOS - Again, it is a personal choice to renew H1B. I dont forsee any exit/reentry problem due to not renewing H1B. Good luck!

It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.

All this poll proves is that new EB3 folks are more vocal. If we really need an action item then start supporting IV with money. Take part in IV action items to call reps.
Face it other option of crying its not fare will not help us.

In my opinion, the biggest sufferers are people in EB3 India or China and who have opted for CP (now guys, don't start lecturing on CP vs. 485. We have heard it enough).

I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.
Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

Here at best he is massively overblowing/ magnifying the abuse.
So the American children "don't have a chance" (?!!) now and these "reforms" will give them a chance?

Can you please explain little more about #2 ie. Open your own e-business and File E visa. What type of e-business to start? How to file E-VISA ? Have you filed yet ?

Folks, I took 100K coverage with I!M_G*G#L^O&B(A)L through the agent I*N*@S#U^B%u^y.
Unfortunately one week before my dad left, I had to take him to ER as he had an attack. The bills came out to 50K+, the insurance company denied all claims saying it is pre-existing.
The hospital and the doctor who attended him at ER as well as the hospital gave me a letter saying it is not pre-existing. But insurance company will not accept it.
The guy at the agent, talks nicely but he says we cannot do anything, just go in understanding with the hospital and pay it in installments. He also says do not file any law suit it is not useful.
All this is total scam, i did pay a huge premium but now i have lots of bills to pay.
So i agree with others, please do your research properly. And do not believe sales guys or agents, they will talk very nicely but when it comes to claims you are on your own...

Indirectly illegal worker issue has hurt us. Now more than ever House has a resolve not to allow increase in Visa numbers.
We should really wake up to the reality and for this year or as a first step just get us to file 485. Believe me even getting this through will be difficult this year.

Personally, I wouldn't consider it obligatory to answer a specific question by someone who cannot volunteer due to "Personal Reason", whatever that may mean. If you cannot volunteer, cannot participate in IV's action items, cannot contribute, then you are most welcome to use IV's portal to get answers to your questions or get other kind of information - but do not expect updates from anyone as your right!
IV is not a top-down organization and if you think that it is becoming like Immigration Portal then partially it is due to people like you who do not want to participate but just want 'updates'.

My understanding of SKILL for US MS is that it will not be counted against the cap. I don't see it saying that PD does not matter for US MS. What am I missing? Thanks.

As ndialani mentioned, just google "cis ombudsman form dhs-7001". Print out the .pdf file, fill it in & enclose all other supporting documents. In the form, it says - you can use extra sheet to put the details of your case. I put this letter that had all my case details (this is the letter I used for everyone after that).
For Napolitano, did you not get the sample letter from me? I have sent it to around 50 odd people and counting .... It has everything, address and whatever else is required. You can just make changes to put your details in.

I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?
2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?
3- When my wife called USCIS, IO told that they cannot do anything before 60 days after the interview. is that true?
I was out of status when I got married so I cannot leave without GC. we want to move to my country but now we are stuck. it is frustrating.
