I dont see any issues here. he is applicable, he has required skill and education. he should be file for EB2
The fact that he's asking whether he qualifies for one, on an online forum, shows his level of skill and education. Enough said :)

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

Thanks guys for the moral support and quick responses.
More details are as follows:
1. This accident occurred in 18 months back in CA
2. We were going on high way and suddenly the car infront of me came to a sudden halt and as I didn't had any reaction time, even though I applied brakes I went and rammed into the van in front of me, which in turn hit the car infront (like a ripple effect) and totally 8 cars were involved in that collision.
3. So at first we thought it is entirely my fault as I was coming at 50s and I rear ended the care which inturn created this ripple effect.
4. But the actual scenario is, the van infront of me came to halt, as it rear ended the car infront of it and due to which the other car hit the one infront.
So already one accident happened and I caused one more and as mine was a 11 seater and coming at 50s the impact was high and involved in 8 cars.
All this happened within in mins or secs, I would say
--> --> --> --> --> --> --> -->
Myself car1 car2 car3 car4 car5 car6 car7
In the above pictorial representation,
a) car 1 hit car2 which in turn hit car3 (1st impact)
b) Myself hit car1 again which ripple effected all the way upto car7 (2nd one)
I was the only person injured and and had to be hospitalized with bi-lateral hip fractures and right knee fractures and was out of work for 4 months.Luickly my insurance covered most of the amount thats been charged(around 300K)
Finally I recovered to a great extent and out of blue gets a lawsuit from the owner of car3 against myself, Car1 and car2.
BTW, insurance determined that my fault is 80% as I caused the greater collision and they paid the property damages for all the cars involved.
As per the lawsuit, seems car3 drivers spouse had herniated disc due to this accident and are expecting $200,000 for future treatment
So they are claiming the following:
3 milliion for : other damages(emotional etc.....)
200,0000 for: future treatment
50,000 for: lost wages
Thats is what the story of my life :(
Hope this gives u more details to provide me with more suggestions.

Maybe I am being naive. But we are not a political organization. I sure do hope we are not. We should be open, clear and precise about our goals and our funding sources/drives. Frankly our opponents pump in millions of dollars into their effort. Maybe one of these days we can compete with them monetarily. But all I know is they can get millions of dollars but not 25000 committed members.
Also please consider that charging people for reading posts et al or instituting monthly payments will drive people away. People who cannot pay will not pay. All we lose is participation which is more important. You will agree that we want more participation not less.
Hence IMHO we disclose our goals. We disclose our costs up front. We have nothing to hide.

frustrated2007,
Thanks for the info, In that case my firms tax returns show healthy net assets , lot more than the proofered wage. But I am still worried about the previous americandesi post about requiring Audited Financial statements to show net assets. I don't think my company will spare the time and money to prepare audited financials.
Please read page 2 of Yates memo (Refer link). The Initial evidence "Annual report", "Tax return", and "Audited financial statement" map to "Employment of the beneficiary", "Net income" and "Net current assets" respectively.

Pappu, what are the anti-immigration websites you talked about? I'm curious and want to see what they are thinking. thanks.

Hope sth will happen in Feb. :)
20/month
These are small regulations that agencies can do. But even for such changes, the time period to get it done is very long (several months to a year). At least DOL woke up and acted. It will still leave a door open for sellers to stay happy and able to substitute labor. However it is not easy to find a buyer of a LC in 45 days.
All these are small problems compared to retrogression. Labor substitution rule will not get any visible or any noticeable relief to us. We will continue to stay retrogressed and wait for another 10-15 years for our greencards. It is important for us to contnue to fight to end retrogression by getting a legislative change done. As long as members are there to support IV, the organization will use every means to get relief measures for all of us. The coming months are crucial to our struggle. We need to stay united and continue the effort of making this organization a formidable force on the hill. IV members writing negative comments on various forums or feel disheartened should know that to get even a smallest job done is not easy. They are not only harming the whole effort and making anti immigrants happy, but also harming themselves by hurting this cause. Sometimes it is sad to read such negatve comments when you know how hard it is to work with limited time, resources, manpower and lack of much needed motivation in members.
BTW In our recent efforts we did give anti-immigrants shivers down their spine. It can be seen from their posts on their sites and also the hate mails they write on our forum and send to core members. You dont see a lot of it because we moderate posts. We are not scared of anyone. All this has only made our resolve stronger to fight it out and fix the system.

Most immigrants apply for citizenship in developed countries for the sheer luxury of visa free travel to most countries and to bring their spouse/families closer to them without any immigration hassles. It has got nothing to do with renouncing all the ties with their home countries.
I know a friend who recently became a Canadian citizen and he said that he was murmuring a Hindi film song when the Canadian national anthem was played during the oath ceremony. The only reason he immigrated to Canada was to get a Canadian passport so that he can work in US and travel around the world without visa hassles.
I also have a friend whos a US citizen and he was able to get his newly wed wife into US in 3 months. He visits India regularly to take care of his property investments, watches cricket/desi movies, loves eating food at the road side eateries and by all means hes still an Indian at heart.
Citizenship is like getting an unlimited credit our existing credit card (GC). The more the limit the more flexibility we get. So lets avoid bringing patriotic fervor into such posts.
I like your response, really -- I think it's frank and hits upon what it means to be Indian at heart.
BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.
not trying to discount anyone's opinions .. it's just the internal dilemma that needs addressing

So is this how you brainstorm ideas at work?
Ideas are just as important as contributions.Your design team at work dont have to write the code as well. If its a bad idea then shoot it down, lets not ask everyone who comes up with an idea to implement it as well. Providing ideas is much better than sitting out there in blissful ignorance not knowing anything about retrogression or IV.
You may wanna read "Six thinking hats" by Edward de bono.He talks about having critical thinking hat(black hat) during brainstorming.Lets have some people with black hats here.
btw I thought anand26 was banned from this forum. I am not too far away from being banned as well. I got a post deleted by the admin already without any notice.
Forgive me for wearing the black hat in recent times and yes I have signed up for recurring contributions.
Oh wait. I get it now. We're probably mistaken in thinking anand26's idea is to improve IV; looks like the idea is to promote "yelling at people" as a way of life.
The plan is to do nothing oneself but make a random to-do list for other people; so we should also respond in the same spirit.
Here are some things you should do, anand26; now do it quickly and report back to this forum by tomorrw:
Eat more broccoli.
Raise money for IV.
Do not use "zapata" in a sentence ever again
See. Anyone can do this. Pretty easy. Thanks Anand26 for sharing this idea.

Someone gave me red dot with following comment --
please look at your very H-1 visa application and interview, you would have also said to the visa officer that you DO NOT have immigrant intent. I dont know of a single person who said that they HAVE an intention to immigrate.
I must tell you that my first labor application was submitted in 2002 and since then I have been to US consulate 2 times. Every time, I have put Yes on DS-156 where they ask whether anyone has filed an immigration petition on your behalf. I know that US consulate can not reject my application based on saying Yes in this question, however, if I say no and hide the fact and if they figure that out...I would be in trouble.
Yes buddy, you lied....for a long time and now you are talking!

How true
Your comment reminded me of something I had penned down right after Prime Minister Manmohan Singh visit to the US. It was very depressing.
A White Collar Slave
Prime Minister Manmohan Singhs visit to the White House was well reported in the media and the Presidents acknowledgement of the contributions made by the people of India- Indian Americans was most gracious. He also made a point to acknowledge the contributions made by Indian students to Americas Universities. All this is most heart-warming. However, as a legal non-permanent resident awaiting labor certification (or the ability to work) since the past 3 years I feel bound by invisible chains whose cold steel refuses to be warmed. The labor certification process is technically supposed to take 12 months.
Post 9-11, grinding to a near halt the labor certification process of permanent residency applicants is a win-win opportunity for the government. Get these highly skilled laborers on a short-term lease of an H1B. Pass off the bureaucracy and red tape of the INS on the process of Homeland security. The latest breakdown, the INS information technology system has been down for 6 weeks now. When asked questions about a status of the system, they donot respond
HIB visa holders make money in dollars that certainly affords them a higher income than would have been possible in their own country. I donot want to undervalue this benefit. But, the American government and citizens hugely profit from the brief stay of these H1Bs in America. H1Bs make money, 99% of which is placed in American banks, which enables banks to fund American projects of citizens and noncitizens. They buy American stock, pay into a social security system and a pension fund that the may not have access to when they themselves are seniors- after all the H1B is only for 6 years. Besides the obvious monetary contributions, they contribute culturally, linguistically and through charity to American society
While they are contributing in as many ways to the American society. Their own lives are in limbo. Continuously stressed over the next rule change in visa status that may affect them, or visiting relatives. Their able spouses unable to work due to visa restrictions. Most of them, live in clean, minimal living comforts as there is always the thought of having liquid cash as one may need to leave the country and then having expensive electronics, cars or furniture may not make any sense. For most of them it does not make sense to own a house on a 6-year work contract.
The opposing argument is that HIB visa holders are subjecting themselves to this lifestyle. After all there are no visible chains around their feet, they are free to return and contribute to the economy of their own countries. But the American dream is an invisible chain currently held by INS merchants as they pull, push or decide to hold steady their white-collar slaves.

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.
We should talk to the senators...and contribute funds
Lets ask 1v if its ready for the challenge to lobby for the unused visa numbers.

Can anyone provide some useful insight based on personal experienceas to how valuable is Part Time MBA for oppurtunities in India?
I am IT professional with lot of experience and currently pursuing Part time MBA from a business school which is ranked in top 25 and not in top 10.
The way I see it that it will take me around 4 years to complete it and I have to invest atleast $30,000 even if I get employer to pay a part of it.
In the end if it fetches me a top notch management position it will be well worth it. However I see limited chances of getting into management positions in US just based on MBA degree however I am not sure about India.
Any thoughts?
