    I have checked with my company's lawyer and he said I can maintain H1 status with my current employer and use EAD for part time job. I read murthy chat transcripts and same topic was discussed with two different answers. ................
    I work for a very big company ........................I do not want to be limited by work authorization limitations...

    Thats my oppinion...

    Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
    If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

    I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.



    Thanks every one for all your responses. Good to see many responses which seem to echo what I was thinking. After reading many posts on these forums I thought many people chose to keep H1 (some times at a cost).
    Now I see many people are ready to dump it if they see an opportunity to use EAD. That is good to know.

    Although we cite the cost savings (from renewal of EAD) most people if not all who prefer to keep H1 status will definitely renew their EAD/AP just to be safe. On the AP case, I got 3 copies of multiple entry APs. My attorney told me to make copies of it and give only copies at the POE and point out that it is a multiple entry document if the officer wants to keep the original, so that the original stays with you.

    I guess many people want to put the EAD to productive use. Some thing to supplement your main job/income.

    You guys are amazing.. I have one hypothetical question.. Please pls let me know what you would have done in the below scenario. I think a simple yes or no answer is what I am looking for.

    PD is Apr 06 - I-140 approved - Currently Unmarried � WILL TAKE ATLEAST ONE YEAR BEFORE I GET MARRIED - My Spouse will be residing in India at the time of marriage - Spouse would not have any valid U.S visa (H1 or L1).

    I have read this thread and others, and I think I understand a little on how the process works. I am looking for your gut-feeling answer if I should apply for 485 or wait till I get married. Let�s assume that my marriage will take place only after one year from now.

    I know it�s a very very tricky situation, I am very confused. Obviously, my preference is to wait for a longer time to get my GC, than separated from spouse for years.

    Should I apply for 485 or not?

    I am not able to start and feel that there is already hidden membership is there. Is there any thuth in this feeling? How does IV is working in terms of access rights?

    IV is already not member friendly. With 25,000 members, raising 30,000 is getting so difficult. Why so? I once posed the question and moderators conveniently deleted it.

Just because we are trying to understand a very obvious change in policy from USCIS, it doesn�t mean that we are against you or anybody in the same position as you. I am happy that EB2 India has established a cutoff date, but I can still ASK questions on this forum. Stop patronizing people and CHANGE your tone.

    Anything you could contribute is great, but yeah passing on the message and encouraging others to contribute will be most helpful and that will generate more contributions.

    I haven't seen any other movement as big as this and as productive and valuable as IV core team is doing for immigration community.

    I agree.All these are "workarounds" that we are asking for - such as letting spouses work, let us change jobs freely etc etc acutally just amount to asking for all the benefits of a green card without having one. IT detracts from our primary goal and puts us on the defensive with respect to anti immigrants - we now not only have to defend the utility of H1s to the US economy (shortage of technical skills etc), but even H4s and so on ..
    thanks for explaining. my suggestion then is to go to school on F1 (maybe ?) and get a degree that can help him/her get a job that qualifies under H1b.

    Our main goal to solve the retrogression problem.

    What I really wanna know is how Grassley will react to a H1 visa blackout in April 2008.

    If he fails to get his $5k tax hike before April and H1 blackout in the first day as expected, then it just adds fuel to the fire - he will rev up his war-drums again. But if he gets his way and H1 blackout anyway (if not in the first day then soon due to pre-existing demand from 2/3 of the applicants who lost the lottery last year), then he looks like a total a**!!

    Maybe it's in his best interest to not touch H1 before then. I mean this must be why he was rambling about how he could be willing to increase caps if he gets his tax hikes...

    Indians who are now citizens. They will want less Indians to reduce competition for their jobs or for their children.

    I dont think they will stamp like that...If you show only AP they stamp I-94 based on its expiry says AOS pending or If you show only H1-B visa on PP they stamp I-94 based on Visa expire date..

    But showing both at POE doesn't not give any value and also it might confuses IO..

    Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.

    HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.

    Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???

    However as "Ramba" said in post# 27, it is still a small chance as no one knows what is exactly the CIS rules.

    eb3_nepa's request is valid in the context that spouse of an L1 can take up any Job.. & the spouse of the proposed 'Blue Card" can take up any job.. why not a H4?

    I cannot agree with you more.

    On the other hand for those ones that say that we (H-4s) could apply for H-1B easily, it is not easy if you are not in IT. Some people said -although doesn't make much sense looking that L-1 and Blue card spouses would be able to work-, that if you do not want the H-4s to compete with average joes?, then an intermediate solution is to require a Bachellor degree minimum education requirement for getting the H-4s a H-4B (my new name for employment authorization), yes, dependend on the H-1B, if the H-1B is laid off the H-4 would still have the chance to apply for H-1B (without counting in the yearly quota) or leave the country after 6 months. Why should we get a F-1 visa?, most of us arrived highly educated.

    Most people do not seem to understand that the spouses of L-1s (legal) can work, and the spouses of Blue card holders (Agjobs) would be able to work, so leaving the H-4s out is DISCRIMINATION!

    if you all use little more IQ, you will realize that only with donation/money you will make a difference.
    We all are here to make someone rich(employers, local businesses). So if you can make polititians rich, they will do something for you!
    So stop calling... start donating to IV...

    Money is important and has its place in the process. Grass roots effort is also important. What would you tell if some one asks which eye is more important to you? left or right? If this Q was a stretch, ignore it. I just used it to tell that $$ and grass roots efforts are important

    Money does not get every thing done. Corp America is doing everything they can to get H1B numbers increased. Do you think they are being stingy with the money they need to spend? They have stronger opposing grass roots groups like Numbers USA, FAIR etc. Our issue is a lot less volatile compared to the H1B increase issue. How ever our issue is unknown to many lawmakers until recently. I am positive that some members came to know about the bills when we called them or have been approached by our state chapters.

    I might be wrong, but I think EB2 India came only uptil April 2004.

    And the next month (July) EB2 India became current. That is when visa numbers were issued to already pcoessed Sep 2004 cases and approved.

    Not true...

    In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.
    U r wrong here my friend. In EB, visa number is counted for each dependent.

    So How come all we hear from the core team is requests for contribution? There is no detail of any actions/efforts that are happening currently? It will certainly be more engaging for all members to at least know what efforts are being worked on currently? I think expectations need to work both ways otherwise you just have an autocratic organization that has to follow and do as the leaders choose to do.     Have you even made a single contribution? Or just made demands to get updates?

    Before you talk about autocracy, look up its meaning in a dictionary. Nobody has forced you to join IV. Nobody held a gun to your head and told you to come to this forum.
