How can an Annual report prove "Employment of beneficiary" and he/she is been or currently is paid the proffered wage??
All of the following can be used to support Annual Report.
FUTA and Annual Reconcilation statement (Form 940, DE7)
Quarterly wage report and Tax return for the past 4 quarters (Form 941, DE6)
Payroll summary report
Paystubs for the entire year
W2's

I would say ignore. If the hosts dont even use 'controversial' to describe him it's pointless trying to call in - its going to be an 'immigrant hate-fest' whether you call in or not and you are not going to win hearts or change minds. I remember 4 or 5 years ago he was raging against the H1 on air as usual and turned around to his staff and asked if CNN too was using the H1program - and the answer unsurprisingly was 'yes'. He has no sense of shame or a modicum of decency - none of his staff members either. And IV is ill-positioned and too narrowly focussed to take him on in any meaningful way given how a core member spoke against the z-visa (for illegals) to some n.carolina newspaper. But again I could be wrong so someone could give it a shot

Before giving an analogy, think twice.
If black hats were around during the Indian independence movement, here's how it would have been:
In 1930's
Black hat: "What the hell, Gandhi! What good did salt satyagraha do? Where are the results? What did you achieve in the last 15 years? Change the leadership."

This is real good discussion. I just wanted to know if anyone has travelled using AP multiple times. I just came back from Europe and used AP to reenter. I am still maintaining my H1B status, but I would like to travel to India again in December. I will be using AP again.
Is it possible? Any one sees any issues with it?

I think it should have minimal or no impact on your GC process. Somehow you can get gc. But what is the impact of case in your personal life that is more important. If you have an asset or money those are under risk. But if you have very less savings what they are going to achive by sueing you. Also did you have Insurance? Then they might put you and your Insurance company in lawsuit. Then your Insurance company may fight for you. If they win the case and court ask you to pay 1 million dollars then you can file bankruptsy protection and come out if you have very less money. Fighting is always better option than giving up. But again it is individual's decision. As you have option of going to India. But no such option for Americans

Starting a Recruiting company for Nurses will be a good idea now. There is a heavy shortage for Nurses in USA. It is easy to bring qualified nurses from India to USA. IV can start a recruiting company with the help of 5000 members.
If 5000 members contributing atleast $100 to raise the initial capital,we can easily make a Good company with 1/2 million capital asset.Everybody will be share holders of the company and they can get profit every year. We need to employ 2-3 persons for marketing and administration.

Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

That is correct. Since H1-B petition is filed by employer, it can only be legally challenged by the employer only. Employee is beneficiary and therefore has very limited legal rights to challenge even if petition is denied.
Now, consider this hypothetical example, on practical note, if an employer files a legal suit, the employer must be able to defend his H1-B obligations for all its employees. That includes paying H1-B wages on "bench", H1-B worker working on sites specified by LCA, reporting to USCIS when H1-B worker resigns or is fired. This could be problematic for many small-time job-shops (aka body-shoppers).

i will go ahead and give my take on this based on my experience
1) some doctors DO NOT give a waiver since they think its OK to take a TB test during pregnancy itself, let alone not taking after child birth. so call the doc b4 you go.
2) I believe as long as the doctor gives you a blanket waiver it should be fine, thats all the proof you probably mifght need..
I dont think USCIS is so crude to go into getting excruciating evidence in these type of situations...good luck;)
I would call the USCIS if first off , they could give you more time..saying that she is traveling....if not get a blanker waiver..
Our immigration doctor, as a std. practice, don't do TB test during pregnancy. That's the reason we didn't do TB test for her during July 2007 fiasco.

I am thinking of starting a google group for people who would like to send letters to USCIS/White House for our efforts. Not sure if we already have IV, if we really need another google group but the main aim for doing this is to send reminders to us to send letters and once in a while have discussions on what affect our efforts are having. Do you guys think its a good idea? I think I should start a poll for this

I wasn't the lucky July filer, I am sure their are others like me waiting.
DO a rally and I will be there with contributions, do something big, I am sure more like will join the cause. Not a free rider but at the same time don't like to be taken for a free ride!

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!
