my I-485 was pending from 2001 and then my case was transfered to NBC I had an interview and then I got the I-797 Welcome Notice welcoming me as a permanent resident of the United States and it said on the notice you will get your green card in the mail in about 3 weeks and then checked my online status it said we ordered the card for production
ok at this point everything is looking good
and then after 5 days check my status online
found the following :
##################################################
Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on November 29, 2007, and are now reviewing our earlier decision.

I think we should also hear from people who have taken action and what their experience was. This may give ideas to others.
I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.
If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.
If any one needs info how to proceed send me a PM

Thanks TonyHK12. I see that so far you have kept it cool here...inspite of some provocations :)
I for one very much appreciate that. Please keep it up. We do have common goals that we can work productively towards.
thanks. something needs to be done about the people following me around and creating provocation at every opportunity, as they say - flaming. I guess it comes from having an inferiority complex.

Boy! you thinking every EB2 is masters and every EB3 is bachelors?
Never visited IV? Thank you
First and last post in IV? Once again, thank you
Never contributed or will not contribute? We are not begging you to contribute. So chill Doc.
Next time you decide to tickle your tonsils with your toe-nail make sure you have your facts right.
Let us start a fund for this guy's ticket back-home.
I will contribute for his air ticket back home. I wonder who gave him PH D? I would like to get PH D from his university and become eligible for EB1

I guess I feel more and more hopeless by each second/minute
My PERM application (5/28/07 PD) stuck at Atlanta
In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....
me...really sad....

IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.
1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.
Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"
Supporting argument:
There is no country cap on H1/L1 work visa then why there is country cap for permanent residents.

I like your idea but the minimum is 50$/ month or 100$/ month.
Infact i like the idea of 5$/ month.
If 20,000 people donate 5$/ month = 1.2 million $/ year.
= 1 million $ (after loosing transaction charges)
So next step enable 5$/ month to 100$/ month RECURRING contribution arrangements ASAP.
To avoid transaction charges let users pay quarterly or half-yearly recurring.
i.e. if one wants to donate 5$/ month so it will be 30$/ 6 months etc.
Rgds,
Kris
I was thinking about this today.
All great Ideas and we are never short of Ideas on this website. However, we are always short of commited people who are willing to put in time and make their Ideas become a reality. We sure are 25,000 real members and If each of us commit 10$ every month diligently we have a consistent cash flow of $250,000 every month and committing 10$ every month is not hard at all. All of us in here are highly skilled, we all have decent paying jobs and we are definately not cheap labor because we have US Department of Labor (DOL) certifying our salary before we take up any Job in this great land.
Would you be willing to the lead on making your Ideas become a reality. We have very few highly committed members in here who can provide support and guidance.
We have already guided a few people on how to donate amounts less than the ones that are posted on this website and it is really simple. Any amount can be sent in as a donation through paypal to donations@immigrationvoice.org

Again, including her name on your I-485 application would not help her to "get into the queue". You need to file another I-485 for her and you can only do that if she is physically present in the US. (you need the I-94 card). You could have the court marriage in July and bring her here on an H4 or other visa, and then file for her I-485 as well.
I am in a similar boat as you, except my ritualistic wedding would be in Aug and I am banking on the hope that the dates would still remain current for August.
[QUOTE=manojp4]You cannot do CP for your spouse unless your I-485 is approved (an immigrant visa number is available for you). That is why the adjustment of status within the US is so much more preferable for most people - it lets you and the spouse get the EAD and start working without waiting for the approval of your GC.
Thanks manojp4, appreciate your help. Just to clarify my doubt, she would need to file a 485 anyhow, before the dates retrogress again, right. Would it matter if I included her name in my filing, along with the marriage certificate. I guess all I am trying to understand is I know 100% that I will be married before I file, would that help her in anyway, lets say if the dates retrogress in August and she cannot file till then.

I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? Thanks guys

I do not believe that fixing the immigration issue is high on the presidential agenda - especially since the effort is to tie the illegal immigration with legal immigration package!!! We've spent all the money and time in doing the right thing and unfortunately, it looks like we'll be spending more money and make USCIS and Immigration lawyers' bank account fatter!!!
However, the take away from the debate is Obama seems to realize that immigration isn't responsible for all econonomic doldrums - atleast they realize that!!! And there are many legal immigrants who ended up being illegal for things out their control and lack of funds!!! In a way its good, but the bad news is legal immigrants have a long long way to go - and there is no telling when the tide will turn against us!!!
And in this slow economy, its hard to maintain the EAD status - given the dreaded USCIS policies on job changes!!!

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

(i) I heard after filing 485 I could change employers? Yes or no? If yes, then which state would I be in? (EAD, AP or none)?
Answer - You can change employer after 180 days of pending 485 using AC 21 and you would be in EAD and use AP to enter US
(ii) After filing 485, do I HAVE to get my wife into US before the dates retrogress again?? Whoa never heard that...are you sure?
Answer -Yes, if you dont, you would not be able to file for her if the dates retrogresses again, also to file 485 for your wife , she should be in US at the time of filing 485.
(iii) Is there no step after 485 filing that I can keep postponing to not let 485 approve (like delaying 485 fingerprinting multiple times) so that I can let 485 approve only after I am married and can bring my wife in?
Answer - No, you cannot postpone it on your own will. But if your marriage date is before 485 approval (even one day) and tour wife could not make it to US, she can come to US using follow to join process. That process is also available if PD are current. In that scenario you ask USCIS to send US consulate in India to send a notice that the principal applicant's 485 has been approved and since the marriage was before 485 approval, she should be called for Interview at the US consulate in India and given the immigrant VISA, The Follow to join process is like Consular Processing.
Hope I answered your doubts.
