I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

I got an LUD on 485 when i got AP approved.
Dont even try to rationalise how the f*** those systems are inter connected and how they roll :o
Same with me. I applied for AP and got it approved on Feb9th. On Feb10th, I got soft LUD on mine and my wife's 485. I was hoping thats pre-adjudication, but I have my doubts now. They just probably are checking my 485 at the time of AP approval. :(

I am not sure what you mean by dont worry. For me personally paying $4000 out of pocket under my current circumstances is a lot. I agree,the PD may not become current soon unless something weird happens. But I am pointing out the fact that it is not a simple decision for most especially where companies or families with resource limitations are involved.
I really dont see how people are treating this 'holding' as a sign of good things to come. It may be, but the probability is very small. This move is more to fortify their moves by screwing us more.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. The rest of the dhol dhamaka can be done later. I don't want to get married and then have to wait another 5 years to bring in my wifey. My PD is Dec 2003.

Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.

Bashing the system and correcting the imbalances are correct. But some people in this forum are targetting individual persons(some times Senators) and doing personal attacks some times bad words also(I can see atleast 100 postings like that). No one realise the fact that same right we were not able to get in our own country. Can anyone talk to MLA or MP in India by phone when they want if any issue?. So we need to appreciate that we got extra freedom than our own country. If we want to correct problems in the system we have to fight with patient with point in mind that we are aliens compared to those who came here 20 years or 100 years before us.
Everyone on this forum or at least most of us on the forum know what are the downsides in indian system. Every one can write thousands of pages . I agree with you that India has problems and I am the first one to agree.
The momemt one starts comparing both countries , It is a race to bottom. Hope you understand.
At least personally I have so much respect for the system. Dont think that who questions an unfair system is less appreciative of USA.

I am taxed every month for social security though I am not eligible for any of those benifits as of yet. I always thought if that is the price I have to pay to make America my home I thought I would do that happily.
I still have beleif in the system and hopefully something better comes out .
I am just writing this email to complete my civic responsibility and If I dont speak out nobody will speak on my behalf.
I would appreciate if you can educate some people like your dad ...

This is completly wrong statement. Actually, it is otherway. The EB3-ROW is currently enjoying at the expense of EB2-India and China. It is enjoying not only in this year. It is happening since 2005. If you have doubt, please visit DOS website and anayze the statistics right from 1999 to 2005. Furthermore, all the AC21 numbers (about 150,000 unused visas) that was captured in previous years (1999-2001) that came from unused EB2 and EB1 numbers. Theoritcally, these numbers should have been used to reduce backlog in EB2 first, then it should go to EB3. Since no one cared about this, EB3-ROW was free riding in EB2 numbers despite heavy demand in EB2.
Everyone knows that EB3 is heavily retrogressed compare to EB2. No doubt about that. The only solution for this is to increse the numbers. Everyone is working hard. However, it does not mean that one should ignore how DOS/USCIS mis-interpertinng the law and doing harm to EB2 Indians and Chinese. No one here is to sacrifice for EB3-ROW. Fighting to eliminate retrogression and understaing the correct interpretation of law and rule is totally two different issues. Please do not confuse between those.

Thanks. I have seen this document before, and if we are both looking at the same place (top of page 10), this is an average estimate that sweeps lot of detail under the carpet. USCIS's yearly updates (http://www.uscis.gov/files/article/Local%20Processing%20Times_FINAL_11Aug08.pdf) reveal more. As I said earlier, depending on where you live, your processing time can be anywhere between 5 and 15 months. From my visits to several naturalization-related threads, I have rarely seen anybody who became citizen under at least 1 year, going as far back as 2002. You are right, we won't expect another rush now as it was in year 2007 (compare the "Total" number naturalized in 2008 with that in 2007, Table 2, page 3, here (http://www.dhs.gov/xlibrary/assets/statistics/publications/natz_fr_2008.pdf)). But then, who knows what can happen after 5 years.

For Eg : for "Before Nov 01 2002" right now the number of votes are 24 click on 24 you will see which user voted for "Before Nov 01 2002 now check for couple of users for their Labour Approval Date some have labour approval dates of 2006 and 2007

Thanks to the poster who started this thread! He just beat me. Now, this is what we need to know from IV core. How much money did they collectively spend? We need to pay them back, right now! Now, we know what Aman spent, we would also like to know what other members spent. These are the options I can think of :
1. Make this a paid site for the first 3 months. $10 contribution from 20,000+ members would take us to $200,000 in 1 month. Roughly, calculating that the collective money spent by core and other members is $200,000, we would hit that mark in 1 month. The rest of the $400,000 that would be made in 2 months can be for lobbying efforts as the article mentioned that the goal is to get $250,000 more by the end of this year. Core members : Please do not feel 'guilty' for making this a paid site as it is a Non-profit organization. Every body is benefitting from all the sacrifices you have made.
2. From the fourth month onwards, let people decide upon their own how much they want to contribute. But, please allow me to express this idea. If it is going to be $10, $20 one-time contribution etc., we can convince more people (Friends) to contribute instead of $50 or $100. Congrats on your Canadian PR. I am sure, you will definitely do good there. I also agree with you that we are all here caught and dealing with this mess. Some of my friends moved to Canada because they could not deal with this immigration mess - they struggled initially but now well settled, have their own businesses, do a lot of things, have a big community, enjoy their weekends and really doing excellent in their life. So for you - when you go to Canada - things will definitely work out.
Now coming back to global migration and countries where people go - your view is very narrow and centric about Indian companies doing consultancy work. Global migration is common, every country has its policy on these things and we must be glad that in today's world we do have a choice.
For a lot of Tamils in Sri Lanka - migration has been the best optionn to survive. To people from different countries migration has been a boon.
For America in particular - Skilled immigration has been a very important part of immigration to keep the country competitive and make it the best nations in the world. Mathematicians, professors, researchers, teachers, cooks, doctors, nurses, therapists, engineers .... I can go on, Tell me what not - everyone come to America in their own channel - a process that has been created and being followed. Now, the big issue is about retrogression and how it is diffficult for imigrants - this is a known issue, but unfortunately the law was written long back and does not seem to fit well for today's world.
If people got their Green Cards through consuting companies, they did follow law - so lets not blame them. If you think it is unfair, you must work towards conveying your cause.
The good thing about organizations like IV is that it provides platform where people can voice their opinions and work towards a change - so there is no need to discourage people.

Congrats on your Canadian PR. I am sure, you will definitely do good there. I also agree with you that we are all here caught and dealing with this mess. Some of my friends moved to Canada because they could not deal with this immigration mess - they struggled initially but now well settled, have their own businesses, do a lot of things, have a big community, enjoy their weekends and really doing excellent in their life. So for you - when you go to Canada - things will definitely work out.
Now coming back to global migration and countries where people go - your view is very narrow and centric about Indian companies doing consultancy work. Global migration is common, every country has its policy on these things and we must be glad that in today's world we do have a choice.
For a lot of Tamils in Sri Lanka - migration has been the best optionn to survive. To people from different countries migration has been a boon.
For America in particular - Skilled immigration has been a very important part of immigration to keep the country competitive and make it the best nations in the world. Mathematicians, professors, researchers, teachers, cooks, doctors, nurses, therapists, engineers .... I can go on, Tell me what not - everyone come to America in their own channel - a process that has been created and being followed. Now, the big issue is about retrogression and how it is diffficult for imigrants - this is a known issue, but unfortunately the law was written long back and does not seem to fit well for today's world.
If people got their Green Cards through consuting companies, they did follow law - so lets not blame them. If you think it is unfair, you must work towards conveying your cause.
The good thing about organizations like IV is that it provides platform where people can voice their opinions and work towards a change - so there is no need to discourage people.

This fellow who wrote this might be one of those arm chair critics who just criticizes everything if it doesn't favor that individual. What a moron. I am sure this fellow is clueless about how much effort is put into to make a legislation.
There has been lot of work done by many IV volunteers just to get a bill introduced. It is so stupid just to trash talk the efforts put in by the selfless IV volunteers.
All IV members has to be proud that we have been able to get a bill that addresses the GC backlogs. Hey one year back lawmakers were clueless about EB GC issues. Now majority of the lawmakers atleast have an understanding about EB GC issues. It is a matter of time before we succeed.
The easiest guage for the success of the IV efforts is to see the response U get from the lawmakers when U write to them about GC issues. Earlier U used to get a generic reply about undocumented workers and broken borders, nowadays U would be getting replies that talk about EB immigration. Isn't that an achievement. As a professional aren't U proud that U are give the respect U deserve rather than getting clubbed with undocumented workers. Ask for U'r self?
I agree that person is somewhat misinformed in what it takes to get a legislation passed. No doubt there are so many IV members who have put in hours and hours of selfless work to get things moved. They deserve unreserved accolade for that.

IVs major contribution is in decoupling the legal and illegal immigration bills (which again were disengaged in many previous bills, till someone decided that they need to add illegal immigrant provisions to it).
