you are asking for EB2 guys in 2004,2005,2006,2007 to wait for EB-3 guys in 2001,2002,2003,2004. Point is well taken. Its a humane way of handling things.
Perhaps they should not make EB1 current, let them wait a year or two while 2004 EB2 and 2001 EB3 get their green cards.
Ask this question to yourself. If you were an EB2 person with 2004 priority with a spouse and kid, Would you be willing to wait few more years to get your green cards so that a 2001 EB-3 shall get his faster and may not care /appreciate your sacrifice?

Here is my suggestion and some of the IV representatives need to analyse what Iam gonna say and see if they can stand up. Being an EB3-I india myself, i totally agree that EB1 and EB2 should be given a weightage and some preference over EB3, but I dont agree to what USCIS is currently following, EB2 With priority 2006 getting ahead of EB3-I with priority date 2001. This is ridiculous and to even think about it, it just sounds stupid. What they can do is , They can move the Dates in both Categories while giving preference to EB1 and EB2 first.
Please dont jump up & down before i complete. Iam just giving you an example of how things should work and how they can move dates forward for all 3 categories while maintaining that EB1 and EB2 gets preference over EB3. Let us ignore Eb1, since it is already current. Now Coming to Eb2, the priority Date is 2004 for them.Ideally speaking, They should not move them ahead until atleast EB3 reaches 2004. But once Both EB2 and EB3 reaches the priority date of 2004, Obviously EB2 gets the preference over Eb3 and EB2 will start to move ahead but not by much, let us say 1 year. Now, Clearly, EB2 is still given the extra preference over EB3 but at the same time, we are maintaining the priority dates between EB2 and EB3 as close as possible so that the system is not totally unfair to EB3 filers. I'm July 2007 filer and per the Aug visa bulletin my I-485 application is current (PD - Feb, 2006). I raised a SR with NSC on 15-Jul to find out the status of my application and here is the response I got from them today:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.
I'm kind of worried as I haven't seen folks getting this response. I haven't gotten even a DMV ticket and not sure why would I get that kind of response. Please advise what should be my next course of action and if there is anything I can do from my end.

Called NSC on 9/3 and IO initiated an inquiry. Not sure if this is equivalent to SR. With in few hours I got a reply email stating the exact following message. It says awaiting review by an officer, but then the last line says "Service is waiting for VISA availability". It's too confusing and it sucks.

I don't think the legal immigrant community has a problem of contributing 20 dollars or 50 dollars to IV. We are sure we all can afford it. Then why do u think members are not contributing?
I think we need to start contribution setup from state level and then the total amount should be be given to the core. If certain state groups organize meetings, email call their members and ask every member for some contribution they will contribute.
The only way is to go approach each member, talk to them, answer their problems and ask for contributions.
this is just my idea. Maybe i am wrong....

Starting a Recruiting company for Nurses will be a good idea now. There is a heavy shortage for Nurses in USA. It is easy to bring qualified nurses from India to USA. IV can start a recruiting company with the help of 5000 members.

Got the passport on Dec 20th.
I am still waiting for my wife's PP (interview on DEC 19th). My friend went on DEC 26th and got his on the same day....

I dont know if that's completely true. I had my H1B visa appointment on Dec 28th in Mumbai and am in the PIMS verification status also. The visa officer told me that all NIV applicants around the world have to go through the process and admitted that the process was new.
I talked to 3 other H1 candidates right after I was handed the yellow slip and they all had the same experience with different officers. Although its aggravating, hopefully, we'll all get some relief this week.

Thanks man!!!, for bringing me in to reality. I thought I can hope and live in dreams atleast for couple of weeks. You are not allowing me do that. You always want me in the reality and be sad that I could not file and angry that USCIS messed it up.

I have seen Mr Lou Dobbs show a number of times over the years. Never have I seen a single good remark he has made against immigrants. His journalism is highly biased and is misleading american people.
