Profile just displays Labor approval date, not application date. But interesting observation. Some have approval date of Nov 2002 -- so very possible that their PD is much earlier.

ICICI Bank are suckers. They charged me Rs. 900 with fault on their side.
They raised the minimum balance from Rs 10K to Rs 15,000 from April 1, 2008 onwards. They didnt notified me in email and letter. But they charged 900 to me , stating I didnt maintained the required balance.
I fought with them that I will take ICICI to court of law and sue atleast 10,000 US dollars if they dont credit the money. The next day, they credited Rs.900 .
I decided not to make any more transactions with this CRAP bank. They will very less dollar conversion rate.

Is this situation only in Chennai consulate or in all consulates in general? I have not heard of any trouble at other consulates. I am taking an appointment this week and will choose a consulate that may work faster (Delhi or Cal).

Deba I am in the same boat as you.....Did not get very clear information till date. But what I have heard is you can travel on AP, get married as long as you have "a" H1-B stamp even if its expired in your passport it should be OK for your wife to apply for H-4 using the latest I 797 approval notice.
To be on the safe side though I am personally considering going for stamping as I dont have much time to wait for an AP as my PD is July 02 and I feel I might get my GC real soon :-)

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

I think, we should start another flower campaign for Condi....she too deserves to be bombarded with flowers....I was appalled listening to her views/opinions TV on the July visa bulletin fiasco....

I believe the guy or girl who made comment on Immigration website has more like a grudge and might be carrying some old IV mistakes like lack of transparency we had in past etc. But gotta understand, everyone makes mistakes and improve.
More, I don't understand that if that guy doesn't want to contribute coz he or she is poor - thats fine. He will still get benifits from IV efforts.

I appreciate your enthusiasm. IV has directed all its members in the past to do what and when? They have also established a webfax mechanism and also asked IV members to contact the senators / congressmen. They have gone into the level of seperating statewise members and asking only certain state members to contact.
Once again I appreciate your thoughts. But the members should follow one direction and it should come from core IV. Do not do certain things without the consent from IV as it may back fire.

Man/Woman, I see so much energy here or could be just shouting. It would be in the best interest to use the energy to contact respective congressman/woman/senator of their area, ask them / request them to bring/pass legislation like SKIL and PACE. Tell them why this bill is needed. Tell them your problem. If everyone of us call congressman and woman and follow up with them on the progress that would be great. Am I doing it? Yep..Not joking IV members are involved.
IV guys can you develop questionnaire which we should ask the operator. What I did is I asked to operator to connect me someone who can help me in bringing immigration legislation. That is how I approached the operator. IV associates what I am getting at is how should people reach right person? As IV people have interacted with many senator office they have better idea what are different staffer there and how they are addressed, and how to reach them.
Let me know what are people thought? I think instead of wasting time, lets get to work. Help yourself by calling senator/congressman/woman. And this is oppurtune time.

I think this is good news, but I am not sure if this will affect me. I have PERM approved labor on my name. I didn't apply for I-140 because I wanted my wife to get F1 visa before doing that. This is because F1 application for my wife can have problem if there is immigration petition and she is beneficiary. I don't know how much time its going to take me to get greencard or work authorization for my wife and I want her to get the advantage of OPT after completing her studies so that she can make her career.
So I guess if this rule comes, I have to apply I-140 immediately? Is this true? Please advice me.

IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question. Clearly USCIS is using one interpretation of the law while there is another possible one.
The discussion here doesn't mean that IV will flip tomorrow and say they will fight for only India/China EB2s.
Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?

I have received email notification of RFE last friday April 3rd. I am waiting for actual RFE mail notice. I talked to IO and she said mail notice sent to my home adress? Typically, how long it takes to receive mail notice? 1 week or 2 to 3 days?

I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.
There could be some background processing going on.
Is there are pattern to these LUDs?
What steps did you take after the NOID on your 485? Just curious in case it happens to me.

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

Anyways, this isnt about looking weak or strong against anti-immigrants. That is really not the issue here.
Its about how much we can have in our list of items. There is only so much anyone can do. Forget about us, even bigger organizations have priorities in order. Immigration Voice also has to have a priority. We cannot talk to anyone about fixing the H4 issues before the issues of retrogression are talked about. And we cannot talk about ALL OF THEM because there is room for only so much to talk about. There is a limit on everything. Limit on how much funds we have, limit on how much political capital does our lobbyist spend on our organization with lawmakers, limit on how much leverage the lawmaker uses to sponsor an amendment for us. No one has unlimited capacity to get things achieved. So in that sense, H4 issues really cannot be on the list. And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief.
