    I agree with the initial post . But the market condition is such that it is very difficult to get qualified people for ERP/CRM applications so desi consultants get placed through desi companies .

    I read through the bill but don't quite understand...if I am working for a client on H1B, will I need to stop working as soon as this bill takes effect? or it only applies to newly applied H1B's (or extension/transfer)?

    Yes, that is my understanding at this point based on the language . As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.

    It is very easy to prove that USCIS did injustice to those with EB3 dates prior to 2004 or 2005 if they stick to the rule of FIFO.
    If the first criteria is met, everyone with a PD older than the lastest EB3 ( I know some who got approved with EB3 PD Jan2007)approved so far should also be approved. Or USCIS should go and revoke the GC's to newer PD and allocate them to older PD in the EB category ( I don't like this option).

    So let us dream and someday it will come true. If we scream soon our throat will go dry.

    I guess the confusion about the future employer being unable to extend the H1 after one enters on AP may have come a couple of responses on Murthy's forum:

    Attorney Murthy : A person may reenter on the AP status and is legally allowed to extend H1B status after that in the U.S. but cannot be on H1B status if the person entered as a parolee. A person has to enter on the H1B status to be in H1B status but is allowed to file an H1B extension if s/he continues to work for the H1B sponsoring employer.

    Attorney Murthy : A person has to receive the EAD in order to work for a new employer on the EAD. Merely having an approval notice or seeing the approval status on the USCIS WebSite is not sufficient to be able to work legally on the EAD. A person does not need to do anything to switch from H1B to EAD. Merely by working for another employer on an EAD, a person is deemed to abandon the H1B status and opt for the EAD, unless the person requests the new employer to file an H1B petition extension with the new employer, in which case a person maintains both statuses at the same time, which is legally permissible. Only after travel abroad and reentering the U.S., a person has to choose to enter as a parolee or on H1B status, but, then, as stated above, one may revert to H1B status by filing an H1B extension even if one enters as a parolee, if one is still working for the same H1B employer.

    A member-driven and membership-driven organization will not have to taunt members into contributing or shaming them to contributing, imho.

    If we become verified and paying members, personal email messages can be sent out for the (less frrequent, perhaps) funding drives. A code of etiquette or something akin to it should be enforced that spells out the rules of participation in forums as well, and discourage such comments.

    You pay the basic membership - you get on board. When extra funding is required, you do what you can - there's no extra pressure or shaming anyone into contributing.

    There can be *plenty of other benefits*, and an organization sufficiently large enough can probably generate enough revenue to have at least 1 full time person on board coordinating stuff... or a bunch of volunteers and part-timers (for folks who have their EADs and are using it, this would be a chance to jump in... and help out).

    I like the idea of an annual $100 fee to join.. that way all members have contributed.

    Secondly, i think while a forum method is good, the Administrators should stop posting vitriolic messages ( For Ex: " I cannot believe people are not donating" / " you should be ashamed.." and such).. This creates a very childish image for this organization.

    If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.

    It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
    next 5 years. But Skil bill is asking too much(May be for permanent resolution of
    gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract
    large opposition and passed easily. Simlarly if H1 increase also limited for 2 or 3 years that can be passed easily as we can convince Senators like Sessions.
    But if we keep on asking so many numbers of H1 and Gc and also exemptions
    for Master degree then we have to wait for CIR as this will have lesser impact
    in numbers compared to illegal immigrants.




    I wonder why EB 3 ROW is stuck at Aug 02. I guess it should move faster.

    I think when you are 35+ and 'you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC' it's practical to invest in business.
    While we are at it let me throw this in....
    Assuming you decide to persue MBA from a good university instead of online. What kind of investment of time and money are you looking at? Is it really worth the investment when you are already in your 30's? Is is worth spending the time and money on a MBA? If you spend the same time/money on a business opportunity wouldn't that be better in the longer run? Is it practical to start a business when you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC? Is it a safer bet to invest in education?

    If you have secure permanent job with a solid Company,it is better to buy a home. I have a well secured job and I bought the house back in 2002. Home prices were less in 2002 compare to 2006.

    But, if you are a consultant or working for a small company ,it may be better to wait till you get GC. But remember one thing, even if you get GC or Citizenship,if you loose your job and have a big mortgage to pay off,you will be in big trouble to make the monthly payment. This is true for even US Citizens !

    But, if you are optimistic and ready to take some risk,you may be making some Good amount of profit in the future ! I was very optimistic and took some risk in 2002 and now I am in a Safer Side ! Think about it

    Buying a house is a risky proposition on H1 specially considering the fact that if one is laid-off and needs to relocate within a short-time then one may end up loosing money. Besides getting into the hasseles of home maintainence is trouble-some and expensive and probably not worth the time and effort if one is uncertain about their future in this country.

    Having said that if an individual is good at taking calculated risks and has a secure job then rewards are truly exceptional. I would rather wait atleast till the time of filling I-485 before making any long-term investments in this country. I know lot of my friends are probably going to do the same.

    If you are not in india, then you are somewhere to earn more than you do than in india. So investment is safe if you can afford to invest in that property without a loan. If you are taking a loan you are getting ripped off. STOP there.

    to me agricultural land is next to investment in gold. agri land always holds value(sale value) or appreciates over time. Always you can get decent return by farming something there. So my belief is you always get 6%+ return on investment over short/long period of time.

    city properties are just a ripp off. So get only one property if you want to live for yourself.. Investment of say 50 lacs on a flat(condo), may give you a good rent. But for how long? and what % of interest you pay on that loan? And what will the aging affect be on that flat!!...
    that way land | house is better choice!


    To me below are investment items first the highest safety + return(decreasing order or preference)
    1. gold(other precious metals)
    2. treasary bonds../govt assured accounts
    2. agri land(either in india or US, in is labor is higher)
    3. city independent houses
    4. select mutual funds
    5. stock market
    6. Condos

    Juist to prove the original posters point about IV being intolerant about different points of view and the trigger happy attitude of some members about giving a red dots just because someone else speaks his point of view - I got a very personal and abusive remark with a red dot just for my post above. Not that I really care about Red or Green dots. My GC journey is over. This forum helped me a great deal when I was waiting for my GC. Now I am hear to help others with what I know in their GC pursuit and help with any on going action items. Just wish some members here would grow up and learn to live and let live! :)
