    So what would be suggest for now? Wait patiently for the approval at some point or follow up/reapply through PERM?
    Is the case is with BEC already, does it mean that the recruitment check has already been done for the case?
    Cannot say really...If you can file a new PERM and keep the BEC application alive and get the PERM and keep ready would be good...If you making the expense out of pocket then that would be expensive...


    One suggestion is hold on for 2/3 months...Then we would know how fast the DBEC is working....You have to analyze the immigration portal tracker...If they process fast may be it is worthwhile to wait....The picture is not clear as of now...

    Donot withdraw from the BEC in any case...

    There is no number that is 'enough'. We need as many people to come in as possible. It is not some kind of 'minimum' required to make it a success. The more the merrier. If we get 50000 people to attend the event, we will have HUGE exposure and may even be able to get a fix to ALL the issues within the next 2 months.
    The maximum numbers will come form EB3 becasue they are the most retrogressed or maybe they have seen their category shafted in so many ways that theyhave lost hope.

    Is this not what you are doing? Because you think IV is not working for all categories, while facts state otherwise, you are putting down the initiatives taken to fix the problems.
    Everytime some law gets made or a rule interpreted EB3 gets shafted. Al the time its is EB3which loses number and EB3 doe snot even get its yearly miserly quota completely. So any initiative which does not specifically address most badly retrogressed category directly is not going to get support

    Rest
    If we talk about reality than i can see that IV cannot do anything for EB3. Not for the want of trying but because reality (as stated by you) is that EB3 is the least preferenced category. That does make me wonder about the qualification of a fresh MS for EB2 when compared to skill set of peopl in EB3 but that is a different fight. As you have so clearly stated there is no hope for EB3.

    What is going to happen is that CIR will be introduced in another 5 years and that big group of people will be placed in EB3 (of coruse because EB3 is the least preferenced category) and all teh EB3 people wil be advised to port to EB2.

    I see the way you twist my words and interpret things the way you want. I did genuinely try to see if you had a real reason for doing what you are doing.

    You just enjoy the negative energy. I do not. You like the status quo. I do not. You are not ready to do anything if it does not have a guaranteed way of fixing your issues. That is not the approach i like to take.

    Unless you are willing to work on it, you will not get a fix to any of your issues. Even an airplane makes continual changes to its course to reach its correct destination. If they decided to not move until every inch is planned to reach the destination, there would be no air travel today.

    The status quo is wait time of over 2 or 3 decades to get a relief for EB3I. So what do you have to loose by working on this? Maybe this will help you too. Give it a try. You may be surprised.

    Does the receipt date mean what is marked as "Received On" in the 485 receipt or online status date which says "We received your case on so and so date"


    My Date on the Receipt is July 12 2007 and Notice Date is Aug 14 2007.
    In the online status it states "We received your application for 485 on Aug 14th 2007"

    Any response is highly appreciated.....Thanks

    What ever your receipt " Received Date" says that your RD not one which shows online..

    My attorney called National Customer Service after the 90 days of filing. They told him that he has to wait 15 more days, and if no actions, call again, so they can begin an investigation. He called again, and the customer service representative told him that an e-mail would be sent to the Service Center where my case was sent and gave him the confirmation #.

    I hope you called the congressmean when IV wanted us to do...

    I have already found out today, SS office refuse to issue non-work SSN to my children, they don't recognize that tax rebate is a benefit. Actually, the guy in SS office was very rude, he did not even allow me to state my reason, keep shouting "H4 can not get SSN"

    We should make action together to fight for our right. Send emails and call your congressman and senator. Make IRS recognize this is a Federal benefit and if IRS can issue the letter, we should be able to get the SSN.

    I already called my congressman and senator, waiting for their response.

    According to IRS web site, if you are H1B holder and your wife and children on H4, you will not get a single dime. Unless you don't file joint tax returns.

    its just naked bigotry thats all..much as i hate *some* of the practices of tcs/infosys, they're a still a legit business getting audited & paying their taxes like the rest of their competitors (who too have some obnoxious hr practices)...why have a h1b process w/fees in place (thats supposed to help americans retrain as well)& then suddenly *just bcos its >50% indians* slap a $2000 brown penalty on them??& whats the sanctity of 50%?the threshold at which its all too clear the h1b lca fails to save non-existent american jobs??this is just racismpure & simple - dont let ur hatred of tcs/infosys blind u to the bigotry here...why not remove country caps & recapture unused visas too in this bill that would help indians waiting forever??

    Did you work during all these 9 years? or were you a student first?

    What is 10 year rule? Do you have to work for 10 years to get SS benefits? Do F-1 visa years count if you worked as a student? Where is official description of 10 year rule?

    Can one confirm for sure that I'm eligible for SS benefits..(Its been 9 yrs and one more here I can spend to reach that magic figure).

    Ok, I'm not much into look at this on pros and cons way..
    The strong points for me to get motivated to go back are:

    1. Kids...I feel its better for kids grewup in india for the kind of importance we give for education. Its hard to see atleast in my experience the true spirit of competetiveness....the way we had....
    2. Career..I worked in india as a lead and manager before coming here...and though no one offered me mgmt jobs here..I'm not ready to take ..due to the facts known to everyone...here we just can't be managers...(not a rule of thumb..)..Now I see better things happening back at home..salaries are amazing....(politics are there no matter where you are)..I'm confortable in saying my savings more or less matches even the kind of income I'm targetting...
    3. Life...guys...I don't know how you guys term it in your experience...but I feel sick in cleaning bathrooms and kitchens and doing laundry and ironing...day after day every day....common...we deserve doing much better things..
    4. Routine:...guys..Its just routine...nothing changes...monotony kills me...

    I don't say things would be rosy there...but...I feel more satisfying in visiting places in india than driving bloody 500 miles around to take photographs..nothing gives you a feeling of belongingness..I am ready to take hardships for the sake of my parents...I want to visit them on demand..vise versa...and quality of life...common guys..we grew up there...don't we enjoy being there till we come here..??..
