    I appreciate your efforts in highlighting this issue. It is a high stakes issue for would be future americans who respect the law, abide by it and wait patiently for their turn in line to apply for
    green card, while maintaining legal non-immigrant working status during years of wait, paying taxes and contributing to social security. I would also like to highlight that in H1B status if one loses the job, he or she needs to leave the country in 10 days.
    I am glad you are bringing the issue of legal immigration to light. After all, thats what everybody wants, immigration to be orderly and legal, but is it workable ? and why people trying to follow the law feel cheated and duped by the government, after waiting patiently for years and abiding to
    the laws.
    The Dept of State and Dept of Homeland Security(USCIS) acted against the interests of immigrants who are trying to immigrate legally. Legal immigration is the real issue. If it works, there
    will not be a need to grant amnesty to millons of illegal alilens. The real solution to stop
    illegal immigration is to make legal immigration work. Unfortunately, the government is going
    in the opposite direction as evident by the actions of DOS and DOHS on July 2, 2007.
    Is government sending the message to people trying to follow the law that, Following the law is
    going to get tougher, just break it, become illegal aliens and we are working on an amnesty.
    I would request you to get to the bottom of this and find out whether right procedures and laws were followed in using the visa numbers ? If not, then the conclusion is, government of United States failed in respecting and following its own laws. Is it not a travesty, that law breakers are
    probably going to be rewarded with an amnesty and govenment is not respecting them either ?
    We are resepecting it, following it and are getting the door slammed on us. I never thought, I
    would see this in America. My impression of America has changed, forever.

    I just don't understand one basic question.

    Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)

    On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????

    We the legals... pay taxes, contribute to this economy by spending earned money here in the US, abide by the rules, carry medical insurance.

    We keep doing this, till we get our green cards or till we permanently leave this country. It is a win - win situation.

    The strict H1-B rules that are added to this Senate bill will be removed or some work around will be sorted out or else the US economy will go down.

    The question now is how confident we are that they will get an amendment to give us some EB visa relief.
    The high tech employers have a problem with the new merit based system which is going to take away the reins of holding an employee from them. Employers of other industries have raised their concern against this new system which gives more points to degrees and not skill. This system is also causing a lot of concern among the familiy members here.This system will take a lot of time to kick in.

    1) The tech lobbyist can add pressure to give relief to current members in backlog so that they can hire them soon. They know that many skilled people are stuck with their companies because they can't switch due to the GC process.
    2) Can add pressure by saying that they need us now and not after 5 years when we get our GC.
    3) We need to force them to understand that they should give relief to legals too when they are doing a lot for the illegals.

    That is all I think can be possible.

    I find it disheartening that a senior member like you would advice someone on foregoing their pleasure trip and donating to IV. Would you be willing to cancel all your pleasure trips/family outings to donate money to IV? If you do, i feel sorry for your family.

    Please donate that extra money meant for leisure to IV instead going to Bahama this year.

    You guys really have to give a deep thought before you suggest names that contain the word slave....

    The argument goes like this : America is a great country. We do not want slavery. Slave labor would undercut citizen salaries. Slave labor should be abolished..Hey..These people call themselves slaves...Let's abolish H1B program...H1b must be abolished...

    Now see where the argument ended up...Think completely what you are getting into...

    I am all for abonding H1B, when did IV promoted H1B program, we have this mess today due to H1B and itz loopholes,

    I don't use word slave very lightly, but we need to accept the fact many of H1Bs are handcuffed with current system, We need system similar to Austrialia, Canada a point based system or very similar to Nurses in US they get GC before even coming to US.

    H1Bs are truly pulling the wages down, I know I did when I came here I have no argument with anti-immigrants with this subject, but giving GCs to these H1Bs will have fair chance to compete in Market

    Corporate leaders such Bill Gates and Senators such as Kennady do know this issue and have deep understanding but they don't give a rat about it,

    IV has been doing a great job, we should all be proud of being a part of it.

    I came across this post (http://immigrationvoice.org/forum/showthread.php?t=10316).

    I think we should keep fighting till our goal is met. Can IV core team shed some light whether recapturing the unused visa numbers is ever possible ? Even if there is slightest change, we should NOT GIVE UP and work towards it. I've read that USCIS have so far wasted upto 600,000 EB visa numbers.

    Now we are seeing some light at the end of the tunnel for multi year EAD or EAD validity during the period of AOS(I-485). Should we roll up our sleeves and work for the recapture of unused visa numbers ? How to make this happen, Please share your thoughts and ideas.

    LETS NOT STOP UNTIL WE GET WHAT WE DESERVE!

    This reminds me of frog mentality to pull someone else down on some pretext or the other.

    What is the definition of "fairness"? Just because my application is waiting to be attended by an adjudicator and others are getting approved doesn't mean that I need to cry out foul. And if we do care for "fairness", whatever "fairness" means to us, then what are we doing, as a group, to seek fairness. I hope you agree that just by posting 3 messages per day on this forum and labeling system "unfair" "broken" etc, system is not expected to start working in a fair way. If you look at the thread to call lawmakers, there are hardly 30-35 people who actually called the lawmakers office. I am not telling you to call or do anything other than helping to make the system "fair".

    I am on a similar situation. Approved on Aug 3rd. Got a approval notice I-485 in post. Called USCIS and they mentioned to wait till Sep 3rd and if I do not get the card to call back after sep 3rd.

    Let's wait for another 3 days and will update what happens.

    Hi
    I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. I hope this helps you.

    I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.

    We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.

    Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.

    I know a fellow countryman of mine who left but did not go back home. He is now in the UK on the HSMP (Highly Skilled Migrant Program). What information do you need? I may have to contact him for his approval, so let me know.

    actually, it's not a bad system, at least in India when you pay a bribe things get done. In a crazy way its probably more efficient.
    here you have no choice, stuck in the line with no way out.

    And premium processing is nothing but an official bribe, to expedite your case. But it's an organized system of bribes: first you pay PP for H1-b, then PP for LC (aka Perm, since atty fees are much higher than for RIR), then PP for I-140, but at each stage you pay a bribe and get stuck in another long line at the next stage. Only way out is by paying another bribe.
    So, in the final analysis, which country is more corrupt?
    India does bribes on a small scale, at lower levels of authority. US does it officially thru the govt!

    Money talks in every country, and frankly I dont mind paying the price for faster service, now if only they would introduce bribes for I-485.

    I am sorry, but I have to heartily disagree with this. Bribing is one of the reasons that India is backward. Don't forget that India has millions who don't get enough to eat or drink, and also has some of the poorest people in the world. Massive corruption has helped creat a situation like that. Whenever a person takes or gives a bribe, it is like robbing someone of what they should be earning. When you pay a bribe, you are in a big or small way contributing to poverty.

    Also, I don't consider the premimum processing fee to be a bribe. The money they get is used to pay salaries to their employees legally.

    I have no doubt that the US is less corrupt, and I am glad it is this way!!!

    I guess different people may have different takes on this, and this is mine.
