My Labor (EB2) was pending through my first employer (Fortune 100 company)...since Jul 2001 and till date no answer...last I heard was it was at the Dallas Backlog processing center...
And then the news came from the employer...lay off....5 years of waiting...all down the drain...
Anyways, picked up the pieces found another job, lawyer filed LC through PERM in Feb 06, just got the labor yesterday Apr 06 in 55 days flat....
Now moving onto I-140...
To be honest, I have lost complete faith in the US immigration system...a country that treats its cream immigrant population so badly, doesn't deserve us...
I feel sorry for you dude....but atleast you were able to find another employer! If you were beyond 6 years of H1 that would have been impossible!

Was there anything in the bill for self petition after labor filing i.e. to decouple EB immigration from the actual employer?

i think yours is a 4-year degree. since you completed your diploma, the university waived an year of study.
isn't it same like students in US taking courses in community colleges and transferring it to the university that grants them the degree. the university is not granting them a 3-yr BS because part of it was completed elsewhere.
universities like cochin university in india accept students to their evening btech courses if students have a diploma. but in the end they are awarded the same btech degree as the regular daytime students.
so my opinion is to get a letter from your university stating that yours is a 4-yr degree. i don't think the university will ever issue a letter stating that yours is a 3-yr program.
another way of approaching this issue is to check if you have satisfied the number of credits required for the degree.
in your case, obviously you have. if i am not wrong, a BS student in US can complete his course in 2 or 3 years or less if he has completed all the required credits. still the degree awarded to him is a 4-yr degree.

I have a 3 years Engineering diploma plus a 3 year Engineering bachelor degree. We were given an advance standing in B.Tech (4 years for people with 10+2) and we completed it in 3 years. So it is 10+3+3 = 16 years of education. (I am from India)
My Attorney thinks this might be a problem at NSC at I140 in EB2 because of a 3 year degree. But it (B.Tech) is in fact a 4 year degree, and we were allowed to finish in 3 years. After 1 st year we attend the classes with 3rd year students of 4 year program. Take same courses and same tests.
How can I convince my Attorney and TSC that it is equivalent to a 4 year BTech degree in India and equivalent to US bachelor degree ?
I guess confusion arises from the fact that NSC does not recognize a 3 year BSc+ PG diploma from NIIT as equivalent to US BS degree.
Edit : My education evaluation was done by TrustForte. Are there any other evaluators that are more familiar with Indian Education system and also trusted by USCIS ?

I think initiative is to target illegal or criminal people but legal immigrants are caught in the crossfire.
Not many people in the Attorney General's office were aware of implications of these for Michigan economy or impact on business or hardship for legal immigrants or students.
I suggest folks call Attorney General's office and ask to talk to folks.
Also call Kelly Chesney 517-373-2520 who is media contact for SOS
Attorney General Michael Cox's office line is @ 517 373 1110 and
He probably did not realize all the impacts on various groups so call and register your concerns.
If he wants he can clarify the interpretation.
Even US Supreme Court has previously ruled upon this fact that for the purpose of Driving Permits , Legal Residents of all types can not be refused a permit.

I efilled mine and send documents on 10/21 and i got approved yesterday though i not yet recieved the same.
Looks like those who efiled are getting approved much faster. In our company all immigration matters are handled by our immigration lawyers (Fragomen) and this really seems to have slowed things down further. They sat on it for nearly a month and now my case shows it was received on the 19th of Oct, but hasn't been updated since 10/22 and is still "Initial Review". whereas yours was received after mine and has been approved much faster. I just hope I get in the next 3 weeks, i am thinking of getting a Infopass and head to the local USCIS office in the coming week. Could someone please advise, I really need to be in India at the end of this month. Is it advisable to travel without the AP and have my friend mail them to me by courier to my address in India?

Depends on your doc...the most time consuming test is the TB test which takes 48 hrs to get the results....So I guess its practical to say that if you were to take the exam wed. morning you can get the report by fri. afternoon or so.

I have 10 th + 3 years polytechnic+3 years BE.As per the EB2 requirement it requires Bachelors degree (single source degree).I am not sure what exactly is Bachelors degree (single source degree) someone please clarify this?? Of course it also requires 5+ years of experience.

I hope folks here know that the tax rebate check is an advance on your 2008 tax return. It really doesnt matter if we get 600/900/1200 because when we file return in 2008, IRS will deduct the money from your refund. No free lunch!
