Did anyone find any precedent of USCIS implementing a law retroactively and cancelling any previously approved petition based on that law? If not, it’s very hard to believe that our interpretation of May 21, 2007 being a cut-off date for EB cases is correct.
I think we are unnecessarily wasting our time debating the significance of this date. Since USCIS did not stop accepting/processing/approving EB immigrant petitions from the so called "DATE OF INTRODUCTION", I just don't believe that USCIS can throw out an approved I-140 petition that was filed after May 21, 2007.
Bottom line is, I am filing my I-140 on May 29, 2007 for premium processing and I sincerely hope that my intuition is correct on this.
I think we are unnecessarily wasting our time debating the significance of this date. I have a question for IV core group. Is there something IV is planning to do to help the EB3-I cause? Before you answer, please read the bullets below
1. I am not looking for answers/responses that cater towards why we are in EB3. I am not concerned about the past, I am looking forward towards the future.
2. I am aware of the campaigns (bills introduced, letters mailed and faxed, etc). I am aware because I participated in each of them financially as well as with my efforts/time.
3. Any campaign that bears fruition is going to distribute benefits in the order of EB1 -> EB2 ROW -> EB2 I -> EB3 ROW and then if some is still remaining then EB3 I.
To repeat myself, my question is whether IV plans to do anything specific for the EB3 India and China group (quite a few of whom have been staunch supporters of whatsoever IV has done till now). An example would be "press for recapture AND apply the recaptured visas in the reverse order starting from the severely retrogressed category of EB3 I and C". Is that or something similar, that IV can do for its loyal EB3 members?

If children are in "Status of Adjustment(I-485)" there are not effected by this aged out issue. What do they need when they go to college?? appreciate some pointers??

Not sure what you mean. But here are some comments that I think are on the right track. They of course have to apply in the same way anyone would and have to find a way to pay the tuition fees and board if applicable. It might be more difficult in some locations than others to get in state fees without a green card but you have to work on that matter with the institution in question. One more thing without green card in hand you are not entitled to any federal assistance, student loans etc. Majority of scholarships require green card too.

I see most guys having arguments in favour of living in US. I wanted to make a few following points:
1. Assuming you were not a careless spender, you have earned enough to buy a decent home in INDIA (all by cash, no loan, if you want it that way). So taking a few more bucks in loan for a better home is not bad.
2. There is security and stability in life. Because you are a citizen of that country.
3. Stop comparing US land to Indian land. Here there is no drain on resources such as land, water and electricity. Once you accept a country, you just dont accept its good, you also have to live with the bad it offers.
4. If you could adjust to US life after living for 21 years in India, why cant your child adjust to India after 7 years of life in US? I thought the way kids are brought up here makes them more tolerant to the change.
5. You have to plan transition. It may take 3-4 years to get decent returns on your investment and then reinvest that money in India. Remember you came here for business (money). American companies want to use you to make more money. Pay back in the same coin. If everyone were to send $100 a month (just like your 401K) back to India every month, it make a huge difference, to your own net worth as well as for the country.
6. Last but not the least, if you are denied the legal rights and the righful place in the society for which you worked so hard, why in the world let your self esteem drop to stay back here? INDIA is our country, country created by our fathers for us fighting the brits. I dont think many of our parents are really happy to see us settle down here after they made so many sacrifices in their lives to create and contribute INDIA.
7. I have lived in US for 7 years, I am convinced that US will always seek to contain the success of the immigrants. But they dont really want us to leave. Rules such as H1B extension after I-140 and not progressing the priority dates mean that they want you to stay here on their term as long as a breaking point is reached. Yeah some may ask why am I still here? Yes I am leaving, but after 3-4 years, when my investments in US have made returns by 2010. After that point, I dont really care, gains or no gains, GC or no GC, because I have made the money and I am looking forward to contribute to my homeland with all the experience I got here in future decades of my life.

I noticed one thing. People in groups like IV have a thousand different types of problem and they scan the messages and skim past without even respondin if it does not directly pertain to them. I am surprised by the type of unity and support the ilegals have gained and I have no hesitation to say that they are infact the better people. Even their website is amazing. The unity is unimaginable and they all stand for each other. This is reality which we have to face. We all seem to be alone until some common issue arises. Unfortunately this does not seem to be it. Look at all the posts that are running into multiple pages!! and for this important issue that an agedout kid raised we have a few posters. Even the one on future Indian PM has demanded tremendous response. I am sure of one thing; unless a commonality arises for all these issues there will never be a true success for any of the EB demands. The reality seems harsh but unfortunately we have to somehow accept it.

One thing that most people here do not understand is that Universities have only two different categories for both admissions and Financial Aid: GC or Citizens get normal treatment. Everyone else, whether they are on AOS or H4 or any other status are considered International Students both in selection process and for Financial Aid. It is very simple - International Students are Not Eligible for Any Financial Aid. They will have to pay Full Fee, which is about 50k/yr in good Universities.
If DREAM Act covers Legal Kids, it will cover those in AOS too, which will enable them to get GC before their parents do and be eligible for selection as a local and for the Financial Aid that locals (GC and Citizens) are eligible.
Getting admission in good Universities is extremely difficult as an International Student as they tend to have a separate quota for international students, even though they refuse to admit publicly that they have such quotas.
I know these because my son went through all this last year.

Maybe we were unlucky, the SSN letter didn't help us some 5-6 years back. DMV gave us a hard time instead.
That why, one need to go from one desk to other desk, one office to other office. Some of the staffs are not qualified. It is just like we have been coming across even Lawyers not having enough information.
I have 4-5 such instances, few to list:
#1. Related to DL itself
#2. Resident fee for H4
#3. Extent H4 is valid with Univ./Lawyer
etc.

while i am waiting for response, i need to explore my back up options.
i need to finish my MBA before i leave this country. I was on my H-1 8th yr extension in 2005. after that i have been on EAD.
My wife is on H-1 but i think she is on extension based on 3 yr extension of my unfortunate 140.
Can I switch to F-1 status next year?
I understand you start accruing illegal time while MTR is pending and if it gets denied? So i don't want to take that risk.
I know i don't have any options, but any suggesstions...

I hope atleast there are 100K working people on H1 in MI. If you form a group and pay 5$ from each, you can hire an attorney and challenge the MI law about DL and income tax.
The lawmakers need to go to college once again.
Knowledge is power and you guys need to show the power of Legal Immigration.

A sooner legal lawsuit will help you. Also invite the dummer Lou Doubs to show our power and privelege and he can stop yelling about Legal Immigration.
I will stand by to help you though i don't live in MI.
The issue is that most highly skilled people are scared and lack sense of unity and standing up for a cause, I am sure everyone in Michigan will now be considering moving out of Michigan but will not even sign a petition to do something about themselves.
In general the educated highly skilled community lack courage and confidence to stand up.
A good example is the admin fix campaign - so much of motivation and cajoling is required to ask the community to print a piece of document and post it - this shows how unmotivated people are.
