Reading the whole proposal, I got the same feeling.
2 sections of the legal immigrants are going to be benefitted ,
EB2 with advance degree from US
Family Based immigrants.
I don't see any provision or relief for EB3 .. guess we gonna left out in cold just like that.
I have seen many asking IV or Pappu to clarify on this , and none has replied on this one, so I believe eb3 gonna be left out in the whole process..

This is my case :-
* I applied for AP on Dec-17th.
* I got Receipt Notice on Dec-31.
* Its with Nebraska Service Center.
* I already booked my flight tickets (departing date is Jan-31)
Now, only 10 WORKING DAYS left for my travel. Once approved, it takes 2 to 3 days for the mail. That left only 7 or 8 working days for something to happen. I am beginning to worry as this could mess up my plans.
What are my options at this time?. Does info-pass help in my situation (Its not a medical emergency)? Should I just sit and wait? or do something?
please advice.

Because if the bill being debated in current form becomes law without any amendments to change the effective date (May 21 2007), all after that date will be screwed.

mrane1, h1 system need fixes but not durbin's bill. you are hurting yourself, you'll know this when you loose your current job and can't transfer your h1 to another company.
Well what you dont understand is these problems are created by desi consulting companies!! Back in the 90's when there were handfull of these guys there was no problem with h1 quotas.. it used to last for full year!! Companies did not have any problems getting an H1! The H1b problem only began after there was a boom in the desi consulting companies!

To put it more precisely, a shortage in labor does not necessarily "shoot pay over the roof", but a real shortage will definitely raise the average pay. Raising the pay does not equal to shooting through the roof, maybe only shoot to the height of a bench ...

Hi All,
Is the copy of previous AP required only when you do e-file ? I am planning to do paper file and the filing instructions do not require previous AP to be sent. It just asks for:
1. H1 Approval (or current status) Copy.
2. I-485 Copy
3. Photo ID (License etc)
4. 2 photos

Correct - No sympathy for those desi MNC shops , they make billions from US market by making innocent peoples to work 14-15 hrs.... I worked with them when i started here at US and know them very well. They play with laws at India and tried to do the same here at US.... Lets not get emotional because the word "indian" is there .... they exploit fellow indians to make huge profit - let them pay some extra fees , nothing for them :)
and pay them paltry salary, force them work 16-18 hrs a day. :D I know so many bright people lost their future because they were put in some worthless/outdated projects. I was getting their offer and fortunately didnt join them. Thank GOD.

I totally agree with you. But the bright side is it only takes less than 500$ to create a company. So if I know how to fool the system, there are lot more people with better skills in this area to circumvent this loophole and make a mockery of the system.

Will increase the H1B fee, that way we "fund" the initiative as conservatives want. In turn we will screw high skilled immigration so that our union guys will be happy.
What we don't care is more jobs being outsourced which will never return back to USA.

Can you post the negative points your lawyer told you about EB3 to EB2 conversion ?
I understand. I'm also in similar situation. Filing another case in EB2 is no doubt best thing to do. Money is not the main factor. But I'm afraid new labor approval (considering PERM delay), I-140 approval and refile (with older PD) may take close to two years (considering current processing time). Also if many of us are doing this then another new rule may be introduced to "block" these cases as they will notice sudden increase of EB2!! Another thing is we're already in AOS pending state. I'm not sure what will be the impact of doing this now. I hope you've discussed all these with your lawyer. I told my lawyer about it and he came up with all negative sides of EB3 to EB2 PD transfer. But I'm still thinking to go for it.

This thing is serious, we have to calculate all the interest that was paid in that account, now since I did not withdraw the money, I'm not sure how to calculate the interest paid in dollars, how to show that in 1040 amendment etc. This is really bullsh*t..

WE can also get the transit visa from India right?. My family is travelling next week and I am not in a US State which has a german consulate, which means I have to send it by post.
To go to India, we do not need a transit visa, so I am thinking of applying it in India for the travel back to US.
Also, when we get the transit visa do they give for the entire duration between begin and end dates (if visa applied from US), or they give two visas for specific begin and end dates.

-As per the Consualte website you need to appear in person. You cannot apply via post.
-I am travelling to another state to get apply for my visa. (to Illinois).
-I asked the consulate if I both my onward and return journey will be covered by one transit visa. He replied in the mail saying they will try to cover me bothways.
-Since you have only one week I am not sure if you could get back your visa within that time frame. The embassy says it will take 2 weeks to send back the stamped passports.
my suggestion is that to send an email to the embassy right away explaining your situation (lack of time) and ask their advice.
