03/27/2007: Continuing Confusion in Immigration Reform Legislation
It is only one week that the immigrant community was elated by the introduction of a fantastic immigration reform bill (STRIVE) by Congressman Gutierrez in the House, but on the Senate side, there is a mess that is continously developing. We reported earlier that the two bipartisan leaders of Senator McCain and Senator Kennedy reportedly rifted their partnership. Now, another Senator is about to add confusion to this mess. News report indicates that Senator Durbin of Illinois may introduce within this week a legislation to put a block on the H-1B abuse and restrict the H-1B worker petitions. This move is totally shocking considering the fact that a rosy H-1B reform was just introduced as part of the STRIVE Act of 2007.
Reportedly, Senator Durbin will propose to make it mandatory that the employers engage in the recruitment of U.S. workers prior to filing a H-1B petition and file sworn statement in the form of attestation that they failed to locate a qualified U.S. worker as part of the H-1B petition. Currently, such attestation is mandated for the so-called H-1B dependent employers only. Additionally, the proposal reportedly would mandate the DOL's annual audit of the employers hiring 100 or more employees out of which 15% constitutes H-1B employees. Once such proposal is enacted, there will be substantial changes in the flow of foreign professional workers. At this time, H-1B visas lay a stepping stone for foreign professional workers to land in this country and to apply for permanent residence.
The late news that the FY 2008 H-1B cap may reach in one day on April 2, 2008 indeed raised a concern in the country as it can be taken as a pervasive abuse of this visa petitions by some employers. Part of the current clog in the employment-based immigrant visas for professional workers is arguably associated with the abuse of these visa petitions. Thank you all for providing some excellent information. Special thanks to members waitnwatch and fromnaija for providing Arizona specific information. I certainly think that I should take this further in light of all the new information. I even talked to my GC attorny and he also thinks that I should have have given resident status.

After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.

I am trying to gather as many arguments as possible to support my case because after reading your post and few other posts, I am seriously considering filing an apeal and fight this unfair practice once and for all.

Dont you get it. berkleybee was a great asset to IV as a core team. Atleast I felt so. Her/his analysis and post on IV were great. All of a sudden BB disappeared from IV.
So I figured BB and IV did not fell out. I for one have great regard for BB and will any day trust his/her analysis.

Is it against the law to apply for F-1 visa while I-130 is pending? May it in some way affect the I-130 application?

Singing a country's national anthem and pledging allegiance to it are two different things. Scroll up and read my prev response.
Pride yourself on being a citizen of the world as you do, in normal course you have to be a citizen of at least one country to be able to receive a passport and travel the same world.... :)
As someone else pointed out, this thread is to appreciate the passion with which Pankaj sang the anthem. End of Story.

I did not feel like signing along for two reasons: we are not US citizen yet, and I consider myself citizen of the world and will always be. I do not aspire to become citizen of the United States of America.
Even when Americans sang their national anthem in a church, I felt not right. Churches are not supposed to be linked to states. There should be no country boundary within the Christian world.

By the way, if the United States go to war with your country of birth, who will you side with? Will the United States trust you?

You are right axp817, but small correction.
Company A (old company) attorney filed I 485 based on the I-140 approval from
company A.
If there was offer letter from company A you can safely say that job was for future. If you did not include a letter from company A then all goes by the argument of future employment. But Finally it should be OK.

I believe all these bills are in response to Bill gates addressing Dept. of Science and Technology last week though he mentioned EB issue he only faced a deaf ear from chair and he stressed a lot on H1B despite of lot of opposition from reps.

I know this isn't a solution to your problem, but some people may consider sending their kids to Canada to study. Canada's universities are en par with the best US schools and the international student tuition is often less than in-state tuition, although the declining US dollar has made it less the case these days.

Hi Folks,
I had been to canada to get my Visa stamped for my 7th in March'07. At the time i was entering United States, the immigration officer did not issue the I-94 to the validity of visa since my passport was expiring on Oct 27th 2007. I have a valid visa until April 2010. The I-94 attached to my passport is expiring on Oct 26th 2007. Do i have to renew my I-94 without fail? Or should i just an new I-94 next time i go out of the country and come back?

I�m bachelor. I�m planning to get married in another 6 months. Should I apply for I-485? If I should, can I add my spouse later to the I-485 application before I-485 is approved and priority date is not current. :confused:
You will be able to file her 485 after marriage and before your approval only if your priority date is current. I am in the same situation and confused too.

I have RN from vermont for H1b extension 1/14/2008 - still pending.
Not that it is really part of the issue here, but Vermont is also processing my I485 - how is it they are almost 1 YEAR behind TX and NE processing times? Will this be resolved by load balancing at some point, or is this random?

In this current scenario , by the time anybody get to file 485 , he/she would have spent considarable time with the same employer with no promotion and pay hike. The thought of to spend another 1 year after green card leaves everyone shivering and hence was my earlier post
