Do you offer professional assistance on immigration or tax (or both) matters? If so, it might help members to know that you do and ways to contact you.
Given how much input you have provided on these boards, I am sure no one would see that as a using the forum for promotional purposes.

What happens to the May 15th cutoff date

I'm not sure everyone who is eligible to apply is out of the woods yet. For instance, if the new bill passes and the May 15th date remains, then all 140 and 485 applications filed after that date will be null and void. So, I guess we still need to keep our focus on changing the bill in it's current form.

They should let people continue if they have a pending LC, like you pointed out we're already spent so much money even though its only to apply for LC.

guys,
I am still waiting for response from agency.
But in the mean time this is what i plan to do (my current EAD expires in jun,08)
1. I will file appeal for 140 and also file MTR for 485 if they deny my 485 as decision isn't considered final according to yates memo.
2. Additionally, memo says there has to be sufficient evidence for appeals to approe case. Now i did show i was paid proffered wages, but the only objectionable thing I see is that I was paid $6k in 1099 continuously for 4 yrs (02-05). My labor salary is 85k. now if USCIS says 1099 is not accepted can we still say that employer did have money to pay me, although it was paid in 1099.
Any suggestions as i am planing to gather evidence in case i have to get into appeal process.

unlawful presence starts accruing from 485 denial date. motion to reopen gives no legal right to stay in usa. Yates wrote a memo that in concurrent filing cases if 140 is denied then all collateral applications are denied/invalid (ie., ead/ap, 485), unless 140 gets approved again. However; if it is denied again then the unlawful presence is from date of 485 denial.
If one is legally here in h-1b then the only benefit you can get from 140 denial is to get h-1b extensions since the 140 denial is not considered final until all appeals have been exhausted. However; you are not on h-1b any longer and you are not appealing 140 but rather a motion to reopen on 485. 485 is not appealable to administrative appeals office.
DO NOT OVERSTAY BY MORE THEN 180 DAYS FROM 485 DENIAL DATE. IT WILL HAVE LETHAL CONSEQUENCES FOR YOU IN THE FUTURE.

here is mine..I thought I was the oldest.
Finished my masters in 1996-1997..
but then I did not start the Labor until Oct 2001. I had joined the company new company in 2000, my boss had told me to start..but I was looking to jump in my profession..as I was doing another masters..and guess wat just after I finsihed my seocnd masters(while on H1only)...sep 11 happened..and I did sense the impending times..so I immediately started my GC fearing the worst..
Guess wat worse did happen..still waiting...in the que...
i have had no change in job.. working in the same company..with 12th year h1..so technically I have been extra six years on h1 only.....I have got closer to Director position..so I guess I have worked hard..one has to do that...
my family moved to canada in dec 2006for PR obligation ..now we all are about to fullfill that obligation and get another PR extsion for another 5 years..so that way we can move anywhere...now us is in deep recesssion..so let us see..how it goess..did not buy house..even now..I went to look for ..but for GC..I dont want to..LIFE IS IN LIMBO...but I have moved on in life..no complaints..and take it as it comes...after ..all ends well that ends well..

It is based on the date on the envelop. Usually such letter are sent using the confirm return receipt.

Filed from Texas.
45 day letter was sent by DOL on 3/7/06.
Lawyer received it on 3/14/06.
Lawyer sent the notice to my HR on 4/10/06 (after sitting on it for almost a month....am VERY upset with the lawyer...but, that is another story...HR is following up with the Lawyer on their delay).
HR responded to the Lawyer on 4/10/06.
HR is also following up with the lawyer to ensure it gets sent out ASAP as the deadline is 4/21/06
Question: How do they determine that the response has been received in a timely manner? Is it based on mail receipt, or them actually entering the data to continue with the case before 45 days are up?

All Indian imminizations records are accepted here. Further, as an adult your wife will need only two vaccines. DTAp and MMR. Get them in India or get them herre.

Everybody please stop scaring others and bashing desi body shoppers. Body shopping IS a business and people of both(white n brown) races do that, Iam also working with a desi employer but just go and look out how many people on h1 are working with these businesses and where else can we work with all kind of nonsense restrictions on h1 like a slaved labour. Rule says the moment your employer terminates your job you are out of status and have to leave the country immedietly,now tell me what happens when you take a full time job and have this kind of situation with a family to maintain and dont even get me started with the whole GC process mess. I definetely agree desi employers (not all) suck blood but tell me isnt he also taking risk by keeping us on bench and allowing us to be there and tries his best to maintain/show us in status. Just put a poll on how many people from this forum are working with desi employers and be surprised. Iam working there by choice(though i had fte offer becz of above said reasons)
As for the situation about h1's being denied my comment is Yes there are few getting denied but by and large most people are getting and i wouldnt call it an alarming situation by no means and the comment from one of our senior members about it being a planned revenge for last year fiasco is totally meaningless at the best. pl dont panic other poor souls here and let us support all our fellow desis who are here to earn his share of bread for his family.

I think someone needs to find out about MI tax law and how they interpret residents in that? If they interprete it in similar fashion then MI guys dont have to pay MI income tax. At least this can be challenged in court. If state does not wants to give you guys a basic service then it does not have right to tax you either. Same goes for Auto registration in MI

Will the IRS really track if we have an overseas account in India with balance over 10k if we don't report it to them? I currently do not have over 10k but planning to add more to that account this year.
They can track it if the account is in a US bank (for e.g. Citigroup). In fact US banks will auto-report your information to IRS. It can not be tracked if the account is in an Indian bank (for e.g SBI).

does anyone have an idea on how much time it might take to receive (sealed ) medical report from the doctor counting from day of doctor-appt ? im just trying to estimalte here so that i can plan stuff. thanks in advance
3-5 days depending on the dr office.
Day 1 - General checkup,bllod work, shots,ppd etc
Day 2 - watch mark on your hand (skin test)
Day 3 - Go to dr and show the result of PPD, if posotive then take xray. If blood work indicate you need to take some shots then get shots required. If dr office has x-ray facality then you can get result immidietely and may get sealed envelop after that.
Since thousands of people will be doing blood work so it may be possible that lab may delay the result for 2-3 days.

This is the most outrageous thing I have ever seen. We got our drivers license 10 years ago when we came as students(temporary student visas). So, are they saying people with H1b visas cannot get drivers licenses?....This is a recipe for disaster and lots of accidents.
