Now the research is out of the way, let me tell you what I did.
I could not get Dr. appointment before July 2nd week in my area. I have to drive 100 miles. So to reduce one trip, I took the vaccinations from my local county health department.
I am not concerned about "what if" situations of 2nd shots as I can convince the Doctor, if need be :)
For the wife, it's a different story. Trying to get a Vaccination attestation from Doctor in India. If not, use the waiver.

No Gurantee that lobbying will always get 100% success. You need to analyse the problem. Affected people are only Indians and Chinese. Rest of the world does not have any issue. Is there any impact on any company because of you waiting for green card? Or is there any impact for country because of you waiting for the green card for 10 years? My answer is it is very little but many companies are getting advantage because you will work hard for the same company.
Is there any impact for you because you are waiting 10 years? Perception varies. Many of Indians do not bother about GC because of AC 21. They think that they can stay as long as they want using AC 21. Even if you get 500K IV members and millions of money timing and Strategy is important for lobbying. There are any of 3 situations you can try for EB immigration reform. 1. Wait till economy improves to expand EB immigration 2. Wait till CIR comes and attach the EB immigration 3. Accept some compromised version of Durbin/Grassley H1b reform bill with inclusion of EB immigration if that comes to consideration. I am sure that 90% of IV members will not accept the third option because many of them fear that they may be impacted by H1b reform bill. And also I do not think any pro immigration or anti immigration bill will be taken up before CIR.
So it is grim situation if you see for next 6 months but it could change after that. I doubt it will make any difference in strategy even if you make a major change in Core Team. Generally in any non profit organisations major changes are hardly happen. But additions usually happens.About lawsuits generally lawyers will decide viablity of lawsuits and success probablity before going for it. I do not know any time IV considered lawsuits any time for any situation.

Most people on H-1B and pending I-485 will qualify as "Resident" for tax purposes.

Hello All,
I have some update from my end, I was busy I didn�t get a chance to update on the site.
My application package got returned to my attorney�s office on Jan 5th
For I-140 they mentioned that the check has expired which was true as my company issues a check valid only for 45 days!!
On I-485 they have mentioned several reasons
Send the application to Texas Service Center
Visa dates are not available
It is our policy to return the entire package even if there is something missing in just one application
The application had the CSC stamp on it showing they received it on July 27th. They letter had December 23rd date
I called the USCIS National customer service at 1 800 375 5283 on Jan 9th at 10:00 AM
I explained the situation to level 1 she transferred me to an IO. After explaining the situation in detail, and providing the information on the return letter. IO advised to do the following
For I-140 include a New Check with the old Fee
For I-485/I-131/I-765 include the check with the old Fee
He informed me to send the applications (concurrent Filing) to Texas Service Center (with the old fee) along with proof of delivery confirmation and a cover letter explaining the situation in detail, as the application has the CSC '07 JUL 07 mark on it there will not be any issues.
My attorney has resubmitted the application with the cover letter on Jan 10th.
I am still waiting for my checks to be cleared.

For the first:
1) we need somebody to draft a preliminary article (not too long and not too short either) and then post it here for others to comment.
2) we need members to list details of TV/other media that have used or corresponded with previously to highlight EB immigration issues. exact contact details will be greatly helpful.
3) Once the draft is finalized and ready with real names (examples) of affected individuals, we can communicate this to the media with lot of us calling simultaneously to press upon them the importance of the issue.
For the seccond
1) once the article is out in the media/youtube/other sources, we can chose the senators and then communicate with them by calling + emailing / faxing
2) people who are near by some of the major senators can meet them personally to bring this to their attention.
Let the action begin.........

I have made several attempts with my local service center and demanded interim EAD but they made it very clear - "We DO NOT issue interim EAD any more". I was even asked not to come with Info pass as they cannot help and my case is under processing with an IO. Now i got to known my file is enroute to an officer and i should hear in 30 days. Its already 120 days now and nothing moved and i dont see USICS doing anything.
My profile is up to date with the email, so pl do send me an email. I see most of them seem to have received the approval but waiting for a card. I havent even made it to approval.

IV T-shirts or not, we need some dress code to identify other folks and be identified by the media and lawmakers. Without some kind of common dress code, how can participants identify IV volunteers? How does the media identify a person as belonging to IV (if they want to do the interview)?

I am glad that you pointed out legal immigrants getting mistaken for undocumented immigrants. Like I have stated several times before - Majority of Congressmen - both Reps and Senators - don't even know we exist! This is the reality. They don't know that thousands are waiting for their Green Card from several years.
They don't read about us in the Newspapers on the front page. We don't visit their offices in large numbers to explain our issues and the solution. In a nut shell, they don't know we exist. So they refuse to believe IV when it makes the case there are thousands waiting. We always get the counter question 'If thousands are so badly affected, why we are just seeing just 4-5 coming to us?'.
The planned Rally + Lobby Day is intended to correct this situation. We are going to show up in thousands to show - We legal immigrants exist. Immigrant doesn't mean only illegal immigrants. Thousands of legal immigrants are suffering too.. After they see us in large numbers, we are going to visit their offices in large numbers. Educate them that we are legal highly-skilled immigrants, our issues and remedies.
If we don't do any of this, status quo will continue, and our bills will continue to receive lower priority than animals - Horses, Cows, Monkeys etc.
Lets do a realty check. These rallies are more at the college/university level thinking. We need to act a little mature and professional.
My idea would be:
Who ever can work remotely, plan to work on that day in the lawns of Capitol Hill. Only arrangement needed is wifi access. Company logo attire with black ribbons/flags will make a bigger impact.
With no disrespect to illegals as people, our last rally was perceived as an illegal immigrant rally. If the congressman addressing our rally thinks we are illegals, there is no bigger joke than that. Let�s correct our image!!!
(I won't be able to participate, as we are expecting our first child around that time frame)

In one shot AG will change his interpretation which can then be applied to Automotive license issue. I think its about time IV take this fight to courts.... Peaceful demonstrations have its place and I believe in Gandhigiri too, but until and unless we strike where it hurt the most (money) nobody is going to give a rat's a** about us. I am the one who requested Attorney Matthew to write about this issue. I am very thankful of him to bring this issue to light as he is a very busy attorney and he still made some time. I guess I should have sent him this forum link but I'm sure he is too busy to read through these. My next step is....I want to meet Feinstein and ask her for all our support...is this possible ?

I had a pretty bad experience entering from Toronto in Sep '09. it was due to the officer's ignorance rather than any actual problems with my documents. Reproducing something I posted on another board on Sep '09. I don't mean to scare anyone or spread rumors but just point out that a lot of immigration officers don't know the intircacies of AP, AOS etc. and things can get tricky. Also please note that I was let back in because I "overstayed" for 3 days. If it had been more than 180 days, the IO would have denied me entry.:
I have a pending 485 applied in Aug 07 (during the fiasco) and have an AP and EAD issued for the second time in April 09. My H1b was valid till Aug 31st 09 after which I decided to go on my EAD.
I took a trip to Toronto on Sep 3 and returned yesterday Sep 7.
The US immigration post was at Toronto airport itself and I was asked to go through Secondary Inspection since I was being paroled for the first time. This was expected.
At secondary inspection, the officer went through my records and told me I had stayed and worked in the US illegally for 3 days. Her logic being that my previous I-94/H1b petition ended on Aug 31 2009, and I left the country on Sep 3 2009. Her contention was that there is no such thing as transfering from a lapsed H1b to EAD. That the correct thing to do is to leave the country and get paroled in before my H1b expired.
I told her that my lawyer advised me otherwise but she wasn't in a mood to listen. She said she will parole me into the US but she will file a charge against my Green card application saying that I overstayed.
She also told me that once "you people" get a little settled in the US that we think we can do anything we like. That "you people" try to act smart and switch between h1b and EAD and get into trouble forgetting that you are temporary residents and cannot have any privileges. And that I had been living in "HER" country illegally.
Luckily, her supervisor interjected and told her to give me a verbal warning since it was only 3 days of overstay and he wasn't too keen on doing the paperwork(when actually I have not overstayed, the supervisor was not smart enough to catch that either).
When she finally gave me my papers back, she said that she didn't want to make things difficult for me because she believed me that I only took my lawyers advice. I asked her if that means she's not filing a charge and she said she will not. I asked her twice and she repeated she will not . However, after that she said "they" are now "watching me" and that I can expect to be inspected everytime I entered the country and I should accomodate for the delay.
I consulted my lawyer this morning and she said that the immigration officer was completely uneducated on the issue and i shouldn't worry and that I have not overstayed.
I am just posting this here so ppl are aware that you can get messed up even if you think you have take care of everything and you even when you have done nothing wrong. There is nothing you can do but bend over.
So in case you are travelling with AP, please allow plenty of time to get this processed. And carry more than required documents and the phone nos. of your lawyer, HR etc. You can arbitrarily be harassed by any half-wit officer who has no idea what she is talking about.
