You wouldn't be able to get h-4 without going for visa stamping.
You can only extend or change non immigrant status without leaving the country and re-entering if you are currently in non immigrant status.
I do believe that uscis will take their time to take a decision. You may want to try to file h-1b petition for yourself based on 140 approval (I do know some people who filed for three year extension based on employer revocation and got it approved. You would have to file it quickly; go for visa stamping and re-enter usa. If they should deny the 485; you will be safe on your own h-1b and can re-start the gc process.

1.Company "should have" the capacity to pay 80k when he gets GC, this is through tax-returns etc.
2.OR he should be paid 80k when he Labor is filed.

I got the same RFE and my 140 was pending at that time. In my denial letter, uscis officer mentioned lot of employees with their WAC numbers mentioned that they haven't got properly paid for each quarter. The letter completely talks about my ex-employer and if your company has many people on bench, even though you are in good shape with your W-2's and current contracts, it may cause problem for your H1-B petition. It don't say that my ex-employer had violated lot of rules on purpose, USCIS happened to be very strict about implementing every rule from 2007. I have contacted sheela murthy firm at that time and they have suggested me to file AC21 after 140 gets approved(luckily approved), file H1-B and another labor , another 140 just in case if USCIS goes after approved 140's because of fraud or any other reason and denies them. I do not have any idea about the impact of H1-B denial on I-485 and i seriously doubt it coz 485 is completely our application. However 140 may cause issues. Please find out about that from a good attorney and please keep us posted. Let me know if you need more information on this matter..

spicy guy, which service center did you apply? if its texas, you are cool, u should get ur AP within 15-30 days max. I have travel in the third week of november and I applied for renewal in Nebraska and my RD for this is August 6th. I am not very optimistic. Cos, per the website, its taking anywhere between 95-150 days these days for AP renewal in NE.

Stick this on our chest and take a snap shot. Collect some of these photos and send them to media/USCIS. At least we can put the photos in IV web site.

Assuming SA2238 passes... It will be the end of 'Contracting' for all practical purposes. A bonaza for outsourcing companies! Lots of projects and positions are going to get outsourced. Some projects may be moved off-site, as in big contracting companies doing actual work in their premises, some will go to India. some H1Bs may be lucky to be hired as "direct employees" by the clients, those who can will switch to EADs (which don't have such restrictions). For others, it'll be the end of the road.
so what does this mean now? I have little less than 3 yrs left on my H1b and I just started my GC process. Does that mean once I finish my 6 yrs, getting an extension will be a problem? Again I am assuming SA2238 will go through by that time....
Also, I have heard that in california H1b extension beyong 6 yrs is being rejected already stating that you cannot sub-contract on H1B

I completely agree with Conchshell statement below i had a chance to be associated with a product which only had 4000 customers initially but as soon as it got focus in india in media, customer base jumped to 20000 in 2 days,So i completly agree that more people will send flowers as soon as this becomes a media newss, 100 flowers is a good start.
We need to make sure that Media news for this even as the website and forum web adress so that more people can come in and send flowers to USCIS.

As Logiclife has stated they will research this issue......
But again, I think nothing will come off it...until we actually see mass rejections and everyone gets together ones again to rally USCIS....to accept applications as promised.

Look at December 2004 EB3 for precedence. They knew early on when they were accepting those EB3 petitions for India, Phillipines and China in December 2004 that they will be retrogressed in 2005 and the rest of 2005 but they still kept accepting them in December 2004 and then kept them intact even after dates retrogressed in 2005.
So if they do this, they will be overturning the precedent again.
The core group will try to verify this information but I dont think there is any reason they would reverse their decision announced on July 17th. It is very likely that the customer service reps are not up to date with latest memo on July 17th.

You should be little more respectful when speaking about H4 issue. Your words are very offensive to me and people like me in this forum. The news does not say anything about non-working spouse in any place. It just implies ITIN = illegal immigrant
