Working conditions are always somewhat hostile no matter which country you are working. I was working in India in a pretty good company but I was experiencing red tapism, nepotism and all the standard problems of a job culture of India. Here in America, we have only one "Seemingly very horrible" problem of immigration problem. But the good part is, it is common to a lot of people ! So why not to fight for it through a common plateform like this one !
I think that is also one rational solution among others.

just check labor certification and your employer letter while stamping or renewal is same .....employers don't remember what the printed many years back ...thats enough for disqualification ....

Friends please help me with some of the question for filling 485.
1. In what status did you last enter US? My wife entered US in H4 in 2005 and then converted to H1B in 2006. So what should I write here? Is it 'DEPENDENT' or H4?
2. Format of covering letter if any needed?
3. Do I have to mail I485, EAD and AP to different addresses or all goes to one single address in one envalope per applicat?
4. In anotherthread it says "5. Completed Period of Stay form. Completed in chronological order starting with first entry into US, and all changes of status, extensions, exits and entries, down to your current status. ". Is this needed and if needed is there any specific format?

andy_garcia, the measures in 2238 are draconian. They are going to treat each employer like h1 dependant employer. The salary requirements are increased. Sub contracting is out. No company with more than 50 employees can employ more than 50% H1bs. The job will have to be advertised first. All this makes it as difficult a procedure to follow as obtaining a green card itself.
For giving green card, I can understand that the government make strict rules, but for giving out H1Bs, why is the govt acting like commies? Shouldnt the companies be able to decide whom to hire, and whom not to?I agree with some provisions of 2238 such as - not giving job preference to h1b or advertising that the job is available only to h1bs

1) Do I need all my I -94 s or just the latest ?
2) I dont really have a birth certificate, can some document like the Std X / School leaving etc substitute along with a notarized statement ?
3) What is with the medical records ? What records would I need ?

"United States person" for tax purposes is anyone who has been in the US for > 183 days in the last year. If you are on H1B / L1 / EAD for >183 days you are a US person. In other words you filed 1040 and not 1040 NR

Yes, by receiveng the letter at least I know that my case was not lost during the trasnfer from SWA to Dallas BEC. My lawer said that DOL told them that they do not have a system in place yet to check the case status. They do not anticipate that they will have a system in place until they are able to issue 45-day letters on all applications, which they anticipate will be by the end of June 2006. Even at that point, we do not know how quickly they will be able to implement a system to provide information on processing times. My lawer also said that they will notify me as soon as they receive any additional correspondence from the Department of Labor regarding my case.
Bottom line my manager still do not have to do anything, becuse he does not have any instructions. Long, long time of waiting ahead ;-(

Do you have a lawyer? what is his/her take on this? Did you use a company lawyer? If you are denied due to ability to pay issues, presumably everyone else during the same time period/similar jobs are to be denied too. Have you talked to anyone in your old co. who might have applied in the same time frame?

If you want to narrow the difference of PD between EB3 and EB2 then many EB3 persons eligible for EB2 need to convert to EB2. If you want EB3 and EB2 PD to become current then recapture bill or any EB reform bill need to be passed in congress. There is no easy way out.
Nobody is even talking about EB3-I. How can we get some help from IV on this matter? We must do something.

came here in June 2001 on H1.
First labor lost when startup went belly-up in 2003.
second LC in March 2005 (EB3). that also went kaput.
finally July 2006 (EB2).
Filed 485 in July 07, now waiting. Used AC-21 to change jobs on EAD after 7 years on H1
