You should be able to get this info from USCIS. My experience has with them has been quite good. You may be kept on hold for 20-30 mins.

Guys:
I hope this is true & I am not imagining things.
I went thru the doc list & I had a few questions for the experts out there :
1) Do I need all my I -94 s or just the latest ?
2) I dont really have a birth certificate, can some document like the Std X / School leaving etc substitute along with a notarized statement ?
3) What is with the medical records ? What records would I need ?

I have a Birth Certificate situation similar as above. I was born in an area of India where it is not possible to go now due to naxalite activities. So I cannot even get a Non-Availability of BC. I do have 10th certificate and School LC and affidavit from my Parents. Should these suffice?

Sorry to hear about the problems that you had to endure at the POE. What the IO said was clearly wrong, and she had no right to put you on a watch list or threaten to endanger your Green Card.
But how did the IO come to know that you'd been on H1 till 3 days before you left the US?
For someone on 485-pending status, all that they need to provide the IO is their 485 receipt (or a copy of the same) and their AP document along with the passport. Nothing more and nothing less, unless they ask for something extra. If we voluntarily provide anymore information or documents right away even before they ask, we're just asking for trouble. They will comb through everything and try to find something wrong. The more documents we provide, the more chances they have for coming up with some dubious charge.
I guess she might have found out about the visa expiry through the H1-B visa stamp on your passport. If so, it's not really your fault.
But in general IMHO, it is better to provide only what is needed.

I filed it over the weekend. YEs you need to. This what my Tax preparer told me. They caught one person who had a lot of assest outide of us 2 years ago. Even though this form has been in existence for a long time, they kind of woke up after this person was caught. So last year they decided that they will let people infomr them about their accounts and not really go after them. I would say they will alteast let people slide for the first couiple of years but after that they might come after people who did not file. Now will they really do it. Your guess is as good as mine. Still a majority of ppl do not report it. Once you are above the 10K threshold for all acouunt together, you are supposed to report all your accounts. Only ones that i was asked not to are life insurance (ULIP) and PPF accounts. Is your tax consultant a desi?

sure. I agree completely. I am on my 2nd year right now and applied for LC. I am not sure what will be outcome of this bill. what do you thin the best bet for me ???

I guess you should be ok since you have another 4 years left on h1. By Oct 2008, you can easily port to the new system, if that is what comes out of this bill when it becomes the law. Keep the LC application going. you may never know.

Answer to original poster: Your 3 year B.Tech is absolutely eligible for EB2, provided if you have at least studied 4 years in accredited college/polytechnic to receive your terminal B.Tech degree, after 12 years of high school diploma. There is a difference between combination of education and pattern of education. Your�s falls into different pattern of education. So, you are fine. I am one of the classic example successfully got 140 approval from NSC in EB2 after a RFE. Mine also 3 year B.Tech. Do not spend money on education equivalency evaluation. USCIS do not care even if you submit 10 evaluations from different companies, they do not recognize. Fist, edu.evaluation is opinion only. It is not a binding document. Gets a letter from your school explaining the education pattern. It is more efficient. I did the same. They approve my 140 on the same date they reciived my reply.

Though I studied in highly reputed schools, I got RFE in 140. It was a big surprise for me. It took tremendous amount of time/money/energy to overcome the RFE, though I graduated from one of the top 10 engineering school in India comparable standard with IITs.

My attorney went ahead and filed under EB3 and got the approval (PP).
Now I have to convince them to process them to file another PERM LCA for EB2. I am on 8th year going to 9 , so at least I can get 3 year H1 with this.

I applied AP for me and my wife @ TSC on Sep 23, 2009. Recd approval eMails today (Oct 8, 2009) and should get papers in few days.

Well I have a good friend of mine EB3 INDIA also whose PD was October 1998 ie 3 yrs before my PD of August 2001. He finally got his GC 4 months ago in June 2008.
f) If you EB3 India by the time GC process is done there is 80% chance you will be either 1) diagnosed with Blood pressure medication before you get GC 2) become a religious fundoo 3) dont give a rats ass anymore.

I spoke to rep at NSC today he said my case is clear and just waiting to be adjuducate based on RD..but when i asked him about the name check he said he do not have an access to that however he again said the nothing is holding up my case just a matter of RD...so what can i interpret based on this is my Name check has been cleared or not?:confused:

The whole excitement was related to the point that IV might be able to get something into the Fence bill that would help our cause. That did not happen even after great efforts from Group IV.
Right now the only bill close to immigration is the Fence Bill. The chances of anything related to pro-immigration happening before the elections is practically zero.

We started a membership campaign in Colorado two weeks back. The idea we have used is 1:1 campaign. In two weeks we have grown from 24 to 40 members. Just start from the place where you work, make a list of afected people, call a meeting, give your state chapter yahoo group address and IV address, and ask people to join.
From the attendees, ask if someone has a friend in some other company. Make that person a contact point for that company and let the same type of meeting happen in that other company. This way slowly members will start joining the state chapters.
Its a slow process but it works. Sending an email to your friend will not work unless and untill some one talks to them 1:1 and explain that if they don't stand up for their rights ... no one else will.
