Pappu....
Do u think the statement regarding giving residency for folks with advanced degrees such as a MS, PhD, etc and a job offer from an american employer has any relation to the category that a person's green card was filed under.
Personally, i have an MS in comp sc, but if my category is EB3, i wonder how that will play out.
Any insights you could share?
Thanks.

As everybody knows, my case was lost for about 4 months. After several attempts to obtain information from USCIS, my attorney was instructed to refile. However, in the interim my original package was found and registered (DEC'07). Then, my second package was registered too (DEC'07). So, I was double charged. I got double receipts, double fingerprint appointment, etc.
Apparently, today USCIS found a letter sent by my attorney on last November, and again he received a call from USCIS.
USCIS wanted to know why my attorney was claiming over a case that was already registered. However, this call allowed him to request the reimbursment of the second set of applications.
So, I am sharing this information, because I think that in my case the letters sent to the service center were the key piece to obtain an answer.
Good look to all of you.

What happens to the May 15th cutoff date
--------------------------------------------------------------------------------
I'm not sure everyone who is eligible to apply is out of the woods yet. For instance, if the new bill passes and the May 15th date remains, then all 140 and 485 applications filed after that date will be null and void. So, I guess we still need to keep our focus on changing the bill in it's current form.
----------------------------------------------------------------------
I think my post got lost in the euphoria. Any thoughts guys ?

I hope everyone is sending out the press release to their media contacts. As you all know, this event is not centrally co-ordinated and everyone has been really proactive in getting the word out.
Same goes for the media contact as well. No single person is emailing/faxing this information out - everyone is doing his or her bit.
Since most of the coverage will come from journalists local to the D.C. area, members there should be particularly aggressive in calling local newspapers, radio stations, tv stations etc.
Let's give this thing one big push.

Q. If I have a valid Social Security Number and my child has an ITIN, do I get extra money for the child?
A. No. To qualify for the extra credit for qualifying children, not only do the taxpayer and spouse, if filing jointly, need valid Social Security Numbers, but the qualifying child must also have a valid Social Security Number.
--------------
On AOS, I think I would hold my 1040 and spend $340 to file a EAD for my 10-year-old son and get a SSN and get $300 back. Last year, we got the child credit with ITIN but I am not sure about this year. This country has gone too far.

Some members may face access to donor forum issues. It maybe due to several reasons.
- Their Monthly subscription may have expired/canceled. If that is the case, please renew your subscriptions and we will be able to provide access within a day.
- All recurring contribution signed up prior to 6/6/09 have to sign-up again. We have made some changes in the system. We had sent emails to some such members. If you took action as per the email we sent, and signed up again then you should be having access at this time and can ignore signing up again. If you check your paypal account, it will show that no payment was processed after the initial contribution were made as part of the recurring sign-up. The glitch was fixed sometime back and the system kicked-in yesterday to revoke access based on the recent contribution history. Since the past recurring contribution is not active for these users, it would be great if they could please sign-up for the recurring contribution and help the community effort.
- If you already have a monthly recurring contribution and this access problem is in error, please notify us immediately with your payment details and we will fix the problem. We try our best to manage this access, however there may have been errors. Sorry for this inconvenience.
- In future whenever you contribute to IV do always let us know your IV handle/contribute from your logged in status so that it is easy for the system to associate the contributions with your handle. Else, we have to find out and associate it manually.
We urge everyone interested in supporting ImmigrationVoice more actively to sign up for recurring contributions. This will help IV pursue its agenda more aggressively. The immigration issue is now heating up and we are involved in advocacy efforts at several levels. We have a lot of work going on/planned and in the coming days many updates will be posted.
- Sometimes subscriptions fail for reasons like credit card may have expired. IN that case you may have to renew your subscription to get access.
Please give us at least a couple of days to provide you access once you have signed up. Note that we verify each member before granting access to anyone. We do not guarantee or provide access to everyone who contributes to IV.
Thanks for your support to ImmigrationVoice
IV members,
It will be extremely helpful if you could send in your paypal receipt that contains the
1. userid
2. subscription # or transaction #
3. most recent transaction date for this subscription
4. IF it is a recurring donation - for how many months
5. your phone numbers
If you could send these details to either ivcoordinator@gmail.com or PM it to StarSun, - your info can be processed faster. Incomplete info will take longer to verify.
If you continue to have questions, please call me 202-386-6250.
Without providing the above information - do not demand anything. For members who have provided the info, I will be getting in touch with you.......thank you for your patience.

Understand.
In general, the basic challenge boils down to what was mentioned in forever_waiting's previous post. It would have been great if IV had the neccessary resources and people to focus on PR and educating and incorporating new members into relevant immigration advocacy activities. But the bottom line is we have very few grass roots volunteers and so one cannot expect the corporate structure with hundreds of volunteers being assigned specific duties. We all have 9-5 jobs and keep in touch via the forum and chip in when IV-core needs efforts on a particular action item (or ongoing action items like meeting lawmakers).
We are a grass roots org and the onus is on the member to seek out information ways to participate (contact starsun..maybe a 2nd, 3rd or 4th time if you do not hear back immediately - since she is single-handedly coordinating memberships, supporting IV core etc). There is a wiki site with plenty of resources as well. Once people actually get involved and get an opportunity to have a conversation with pappu or aman, you will never again question IV's intent or honesty.
Blaming the IV platform for not reaching out to you is a misconception....the actual approach should be the other way around.
You now know the groups involved now and you know the people to contact. Hope that answered your questions. See you in DC in April.. Hopefully.

I'll contribute in any way i can
The point and focus of my post on here was to make IV a little more open and welcoming towards new members. There is understandable frustration among many. Taking it out on each other is simply a waste of time.

here is mine..I thought I was the oldest.
Finished my masters in 1996-1997..
but then I did not start the Labor until Oct 2001. I had joined the company new company in 2000, my boss had told me to start..but I was looking to jump in my profession..as I was doing another masters..and guess wat just after I finsihed my seocnd masters(while on H1only)...sep 11 happened..and I did sense the impending times..so I immediately started my GC fearing the worst..
Guess wat worse did happen..still waiting...in the que...
i have had no change in job.. working in the same company..with 12th year h1..so technically I have been extra six years on h1 only.....I have got closer to Director position..so I guess I have worked hard..one has to do that...
my family moved to canada in dec 2006for PR obligation ..now we all are about to fullfill that obligation and get another PR extsion for another 5 years..so that way we can move anywhere...now us is in deep recesssion..so let us see..how it goess..did not buy house..even now..I went to look for ..but for GC..I dont want to..LIFE IS IN LIMBO...but I have moved on in life..no complaints..and take it as it comes...after ..all ends well that ends well..

Link to actual memo below ....
http://imminfo.com/resources/unlawful_presence_memo.pdf
And where in the memo does it say that pending AOS is not a legal status?
It is just not h1 or l1 - a lot of people fall in the AOS category. Anyone who married and comes here, applies for AOS.
Something just not right with this interpretation.
Have we heard this from anyone else other than this lawfirm?

If you want to narrow the difference of PD between EB3 and EB2 then many EB3 persons eligible for EB2 need to convert to EB2. If you want EB3 and EB2 PD to become current then recapture bill or any EB reform bill need to be passed in congress. There is no easy way out.
Nobody is even talking about EB3-I. How can we get some help from IV on this matter? We must do something.

They may have received the packet on July 2nd but the "official" Recevied Date is the date on which the actual data entry is made.
I think so too, my status says that my case was received by Nebraska Centre on Oct 10th.
I am current, but I do not know if my RD is in August when they received my application first or Oct 10th when Nebraska Centre received it later.

I see a Fundamental Flaw in this. Here is the roughcut of my thoughts...
How can you say that company having more than 50% H1Bs is doing fraud. How about companies having 45%.
What if company has $9/hour or any minimum wage employee 50% and cut the pay for the rest of 50% H1B's.
By restricting the companies to do H1Bs you are taking away the freedom from H1B candidates to change jobs. This in turn will make the candidate bound to the company which gives good scope for armtwisting directly impacting the salaries and taxes. By keeping the fee low you give freedom to H1B's let them compete in the open market. Let the companies pay competitive salaries to the candidates. This will help the citizens because they are all on the same salary levels and will avoid unfair competition.
By taking away the freedom of legal immigrants and companies which hire them you are scaring them and making them spend less. This will have direct impact on consumer spending and thus the economy.
Please be reminded job creation is not static is is elastic. The more you encourage companies to hire, the more they pay, more taxes can be collected and more spending will happen.
Splendid! This is one of the messages we must push, IMO
