I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...

I have not been laid off and I don't have problems finding jobs; in fact my company has asked me to search for one more person with a background similar to mine. However I have been limited by the requirements of AC21. I was toying with the idea of leaving the country; but cannot sell my primary residence and might have problems obtaining a visitor visa for re-entry (to close on the house). I was seriously considering investing in some more real estate; but am holding back due to the random AC21 denials. I want to start my own business since I finally got my EAD this year - but with all the uncertainity of AC21 case approvals, I am not willing to put personal resources into a business in this country. Currently I am working on starting a free workshop for investment in my community - which will stop if my I-485 is denied in case my former employer revokes my I-140 (and yes; I did send in the letters for AC21). I have registered my dog with therapy international and volunteer my time for various causes (cabin repair, trail maintenance, public education) and donate regularly to the fire and police - all of these will take a hit if I have to leave.
I wonder what the reporter will conclude if he/she talks to immigrants who have lost jobs and have trouble finding new projects........

Didn't understand you specifically mentioning "US Stem Graduate" in your signature. What do you want to convey through this statement. Ofcourse other statements looks OK.
I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application

Folks - one must also realize that talking to administration and getting things dione costs a lot of money through advocacy and IV needs a lot of money.
So please be generous enough to contribute to IV - we need a lot of funds in these times when we really needs help
I am not sure how many are there in a similar situation like me. I am pursuing CP and with CP one does not get EAD/AP. In today's economy, it is a nightmare not to have the protection of EAD.
Is there anyway IV can help people in CP queue? Issuing EAD for those CP filers who are already in the US on work VISA - is that even a possibility? I know it is not possible today. The underlying H1B can even be revoked upon issuing EAD. I am not sure about the number of beneficiaries should something like this happen.
Any thoughts?

I saw my LUD cnahge 09/21 on my I-485 and my wife, and got 4 e-mail from cris, that my application was received from other center(CSC).But CSC transfered on 09/14, and sent transfer notice.
I am still waiting for my FP.
What does it mean.Does it mean i get my FP.

Are you out of your mind ? You are taking a huge risk by staying in the US and droping your Canadian PR because of some "probable" green card. What makes you think that by the time you finish school the situation will still be better in US. I hope you will not regret this but think about your family. In 3 years you and your family could be happily in BC with free health care, great weather, less stress, travel wherever and whenever you want, have your own law firm.
OR you could be a stressed H1B (a.k.a educated slave) waiting for I-140, I-485, EAD or whatever to come through.
Just because you asked, I have been in this same situation. But in my case, the decision was easy. I was on h1b making 69k. The same job in Toronto offer $55k CAD. Much less, but with my freedom to consult on the side and my wife's income we bring over $100k. We vacation in Florida for a month every year to visit friends. Life has never been better.
Whoever tells you to stay and take the risk is putting your family's hapiness in jeopardy. But the choice is yours. Just don't come here crying when CIS finds a problem with your application.

My lawyer told me that my H1B status is maintained for 240 days after my visa expires.

The way I see it, this is a step towards getting more revenues for USCIS. With the elimination of concurrent filing, USCIS is expecting more applications for I-140 premium processing, which will lead to additional revenues.
They are going in the opposite direction, looks like our efforts have angered them more than anything else.

It's hard to believe that US economy will go down if they make some tough rules around H1 B visas or worse cancel H1 B program. I means, we can argue that it might create shortage for skilled works but if US really need some skilled workers, they can get it any time ( Like straight green cards for nurses etc). it’s few trillion dollars economy which won’t go down just because of H1-B visas holders.
We the legals... pay taxes, contribute to this economy by spending earned money here in the US, abide by the rules, carry medical insurance.
We keep doing this, till we get our green cards or till we permanently leave this country. It is a win - win situation.
The strict H1-B rules that are added to this Senate bill will be removed or some work around will be sorted out or else the US economy will go down.
The question now is how confident we are that they will get an amendment to give us some EB visa relief.
The high tech employers have a problem with the new merit based system which is going to take away the reins of holding an employee from them. Employers of other industries have raised their concern against this new system which gives more points to degrees and not skill. This system is also causing a lot of concern among the familiy members here.This system will take a lot of time to kick in.
1) The tech lobbyist can add pressure to give relief to current members in backlog so that they can hire them soon. They know that many skilled people are stuck with their companies because they can't switch due to the GC process.
2) Can add pressure by saying that they need us now and not after 5 years when we get our GC.
3) We need to force them to understand that they should give relief to legals too when they are doing a lot for the illegals.
That is all I think can be possible.

You can enquire with the Canadian authorities if they will collect it and pass it on the US post. If not you can take a U turn once you enter Canada and go back to US to give them the I-94 and take a U turn again to re-enter Canada.

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I am July 2 filer, ASC in Bay Area. My case was receipted at CSC with ND Sep 6. It was then transferred and received by NSC on Sep 21.
I then opened a service request for FP on Oct 2. On Oct 22, NSC responded that case is waiting for biometrics at local ASC. I then lost all my patience and on Nov 6 shot off a mail to ombudsman, Prakash , highlighting my details.
Subesequently, my FP notice got generated on Nov 7 and my spouse's was generated on Nov 8.
I am writing the details to highlight that for NSC_CSC_NSC filers, you definitely have to act to get FP notice, especially if you are in Bay area. You might get lucky and fet FP by waiting, but it is better to act.

The voting part is currently over! Please read my earlier post, as some of the vote counts will be adjusted to remove votes from individuals who have the same/very similar IP as another voter for the same entry.
