I never said a law cannot be enacted treating people in the system retroactively. What I am saying here, the government agency implementing such a law will have to go through a night mere.

And I have one more suggestion. Let's fight to entirely stop new H1Bs (yes numbersusa will never oppose that). That might be the only way to get out of this mess. At the very least, if you don't like my first idea, let's lobby to get rid of substitute labor....

I don't understand why people are waiting for approval from IV? We are doing nothing illegal if that is what you are afraid of! Or are you afraid that the USCIS will come after you because you sent them Flowers???
If you think sending flowers are a good idea then send them PLEASE! Currently people have ordered flowers with a delivery date of July 10th. It will be great if USCIS gets them all on the same day!
Don't wait for approval from IV! You are all individuals you can make the decision for yourselves!

Here's something that makes sense to me.
A) If an immigrant worker in H1 or L1 category etc. has been continuously employed for atleast 6 years and maintained legal immigration status
AND
B) His her family has contributed atleast $125,000 towards State / Federal Income taxes + Social Security + Medicare
AND
C) AND has certified Labor application and I-140
AND
D) His / Her family will contribute another $75,000 towards State / Federal Income taxes + Social Security + Medicare over the next 6 years (this could be a pre condition attached that will need to be satisfied at the end of the 6 years or before that).
Then they should be exempt from Visa quotas of any kind.
Other current avenues for GC can still remain. But it is only fair that highly skilled immigrant workers who have already contributed monetarily to the country and who will continue to in the future should be coveted by this country.

I was just waited for a long time. My spouse got RNs in Oct 2nd Week; Everyday I called Cust Serv; I used the get the same answer, "Wait for more time". Finally I participated in CISOmbudsman Tele.Conf. Sent dhs7001 in Nov 1st week.

Hi, What if we have already applied for the I-140 but havent been able to apply for I-485? My case wud be a few months shy of 3 years work ex b4 filing for I-140. How does this 3 years thing work exactly? Or do we have to file new I-140s?

Can you please edit your post in the format mentioned above so its easy for data collection.. .Congressmen were not helpful after CPO Mail.
Applied for my wife's EAD & AP E-file on June 26th.
EAD approved on 10/13, AP approved on 10/20.
Received AP, but not EAD, this is rediculous...
I want to wait until 11/13, if we don't get the EAD by then, I'll report to our congress man.

1. Check the spam folders -just in case- the email goes there insted of
the inbox.
2.Log in to USCIS web site from different computers and laptops,
and computers located in different places if possible.
3.Set up alarm clock (if you manage to sleep) middle of night
tonight. USCIS employees at NSC are famous for working (long) weekends.
4. Definitely check several times through the week end (refer to #3 above).
5.Conduct pujas today and certainly several times through the weekend.
6. Call parents to conduct pujas.
7. Don't forget to ask the in-laws to conduct pujas.
I invite other members to share further tips.::)

I think IV members in every state has to come together and meet the congressmen/congresswoman and submit a letter and voice our problems due to retrogrssion.
This generic talk of "we need to do something" is not working I feel. I mean to say there are not many people who are really "taking things into their hands". Most of them are just curious readers.
If people who are affected by retrogression in every state come together and meet the senators I believe it will be worth it.

Are the democrats shying away from passing any immigration related law? If we are to go by all the newspaper reports on this topic and the democrats' muted post-election stand on immigration and the absence of any immigration related topic in the first 100 days agenda declared by democrats ; it definitely seems like they have their heads in the sand.

Although the President and the Dems said immediately after the elections that the immigration issue is one on which they see eye to eye, everyone has been quiet lately with regards to immigration. Things better happen in the lame duck session. The industry is also waiting for action in the lame duck session. If it doesn't see that, it is going to do some massive outsourcing. So let's hope something happens in the lame duck session.
BTW, those in NY please please send a PM to bottlemani. Guys if we don't do something now, we may have to wait until 2008. We can't expect the core team of IV to do everything. We should ourselves attempt to go and meet lawmakers in person. This, I mean actually showing up in lawmakers' offices, will make a big difference to the core team's efforts.

I am under the impression that one's 7th year H1 is contingent upon his GC being filed by the end of the 6th year. If one's GC application is revoked (by applying for a new GC), wouldn't that invalidate the 7th year H1 too? I could be absolutely wrong here, but this is my understanding.....could some fellow IVer please explain if I am correct?

I just discovered IV yesterday and I am really amazed at the initiative the core members have taken on this issue and how far they have come with it. I have conributed 200$ for now and have registered in the pledge. Please keep the effort live and the rest of us will do all that we can.

If any 10k remittance needs to be reported, I am pretty sure there'd be flood of reports from all H1B holders (many orders of magnitude more than 4450).
I heard there was some new IT rule in India that if your income was below taxable limit, you could file for last 3 or 5 years. That can save lot of us I think...

Ok here is my story. EB3 Non RIR from TEXAS, Oct 2001. Never approved from State, so no advertising was done. Labor went to backlog. REceived a 45 day letter in 20 jan 2006. Lawyer never notified HR, but directlly replied to Backlog center. I am assuming the next communication between Backlog and lawyer will be in regards to advertising, since none took place. My company also applied PERM. PERM got approved. Since PD date is OCT 2001 for old one, company decided to keep that as well. CAn I use PERM advertisement form y Old labor, if and when Backlog will request it. I140 applied for PERM. Waitng for its approval. its been 2 months.
Here anothery scenerio. Another employe I140 application was applied after mine, and his got approved, mine is still in processing. What gives here.
