Having a thread like this is a great idea for it allows us to share our perspectives on this issue. I have been enlightened reading and learning about other's experiences and what they value most in their life. I am like the others in this forum being a victim of the visa retrogression and not sure if the goal of obtaining a Green-card in this country would be realized. I have kept my options open and want to be in control of my life unlike the current situation. I don't mind packing my bags and leaving for India or elsewhere if the situation does not improve.
I am from India and have lived in Europe including UK before moving to the US (company transfer) and loved every moment of my life there. The jobs, culture, social benefits, places to visit, clean environment, law-n-order and public schools makes Europe a viable destination to immigrate in future. I have not given up hope for a Green-card but need to certainly have backup options just in case no steps are take to fix the broken legal immigration system.

please dont generalize ... i think a large number of us incd me... has send the cards.. but withh video need to understand that not all are tech savy... has proper logistics and also the knwo how.... take my case wanted to upload the
video but found out something wrong with my webcam cannot fix the focus of the camera image quality is very blurry... so plz encourage not bully...
its not changing your attitude its rather some people are camera shy...
There are around 1500+ members on the forum at this time out of 20k+ members. All our members are willing to spent time posting messages and speculating what will happen in next VB. But they don't have time to post their video. The members don't have time to send Thank You Cards. Four people deserves thank you card and members don't have manners to send a thank you note. This is unacceptable behaviour and please change your attitude.
Don't blame Immigration Voice if you see a bill with no amendments for us. Sometimes we have worked like a mad dog taking lot of risk. We are requesting you to post your video and sent thank you card to 4 people.
Please let IV core know if we are asking too much from you.
Thanks

I am not able to access donor forum. i had done donation of $200 in 2008. Could you tell me the reason for denying access?
It has been decided to give Donor access based on only current monthly contributions. If you donate $25, you will get access for one month. If more than $25 like $50, $100...you will get access for two, four months likely.

- my company has a clean history of fraud
- there has been 140 approvals as recent as 2 months back, who got the atp rfe and were approved. but i think they were are diff svc centr. mine is vsc.
-IO identified only 4 cases in the NOID t which excess may have been allocated. 2 of them had PD,receipt date and apporval date after mine. they all were in same category. need not to say all of them have adjusted status since then.
technically speaking agency has full right to re-question in a reasonable time frame and 2.5 yrs is unreasonable from any perspective
My RFE was received today. Also sent letter to VP.
Can i afford to file lawsuit. yes. Do i want? not at all.
i will keep you all posted
I can help you (for free, of course) with filing a lawsuit if the USCIS denies your appeal. You have a strong case and should win easily. It will cost you $350 in filing fees + postal expenses. Do not give up.

The reason for July 2007 visa bulletin dates becoming current, was low usage of visa numbers by USCIS.
Read for yourself in the visa bulletin for June 2007 -
Visa Bulletin For June 2007 (http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html)
.
Don't believe whatever is written in Visa bulletin. "Low Visa Number Usage" is an eyewash term used to justify all the insane bulletin movements.
Even if there was low visa usage, why should they make it all current ? They could have moved the bulletin by couple of years.
My take is, gov wanted all legal GC applicants to get in line before illegals flooded the USCIS queue.

Contact big law firms too and request them if they know of cases and those people can be told about this thread. Contact lawyers who have popular websites and blogs to post about this thread.
You need to think of all ideas possible to get more people like you involved in this effort.
I informed immigration-law.com of this issue and thread, and received a response.
How can we create awareness at AILA? Any ideas?

Just came on Dec 26th from HYD through LAX. At POI, no problem at all. Very smooth. Took finger prints, all ten fingers. Checked I-797, asked few questions and stamped & stapled the new I-94. The whole process took less than 5 mins.

yabadaba does not have any issue with paying Social Security taxes and Medicare while on H1B. He thinks it is fair. But so annoyed about dependents of non-immigrants getting tax rebate. What a sense of fairness !
What about non-working dependents and children of citizens ? How are they eligible to receive tax rebates going by the same logic ?

I think you live only for charity and humanity, but i am not.
When my employer hired me, rule was clear "They are okey with me taking 15 days leave once a year". I cannot take leave more than that. If my kid is sick all the time and I take leave (or no-pay) all the time. I would get fired. So If I am employer/I am paying for any service, I can have my own rule. Of course nanny can travel as many times as she wants, but if it is acceptable to me, I would not want that situation.
I don't know where I cross the line of humanity. I work here and I visit my family once in two years, because my employer is not fine with 2-3 weeks vacation every year. And I don't blame him for that because he has to run business, not charity. (Anyways, I really don't support charity a lot, after reading "Fountainhead" or "Atlas Shrugged" by ayn rand.)
I said I am fine with her travelling every 6 months, because I think there is some limitation on visitor visa about duration.
I wish I had enough money that I can let her travel around the world as many times as she wants, and fulfill all the criteria for humanity. ...:D
For 100$ to 1000$, yeah I really feel bad when I go to india and see people working 12 hrs a day and making so less. Even in IT, i have friends who works 70 hrs a week ...I wish I can change this, I wish these people get chance to work in a different country where labor is expensive, so that they get better value of their work. But as of now, let's just hope....
And yes you definitely offended me, but instead of being sorry, please don't try to judge anyone instead of answering questions, and if you have to judge, try to know all the details.
About ur statement "You are a mother and your priorities are different, and are a little low on humility."....I can also conclude a lot abt u, but unfortunately I don't spend/waste time in passing judgement, I have lot more to achieve.
It really shook me to the core when you made your statement "I am OK with her travelling to INdia every 6 months" and then "I want a person who is making 100 $ per month to earn more (atleast 1000 $ per month ...right??)".
You are a mother and your priorities are different, and are a little low on humility.
Happy Diwali. I am sorry if I offended you in any way.

The news that you heard about people being sent back from POE is not completely verifiable. However there is no cause of alarm at all. As I have heard a lot of my friends and their contacts easily getting through the POE immigration on H1B, AP and even L1. So dont worry.
I heard that a total of 8-9 people from TCS got sent back from POE at LA or someplace dont know exactly which POE. But they were all L1 and when asked about their client instead of saying TCS they it seems said "AIG", "JP MorganChase" etc. etc. so they were sent back. Atleast thats the story I gather from one of my friend. Dont know how much it is true or not. But definitely not heard any H1B sent back at POE thus far. Unless that H1B was from a previous company and the person had joined another company but was trying to use the old H1B stamp from older company.
I myself came in through EWR in November and all was perfect. In fact me and the POE were so cool and talking to each other we even were talking to each other about how hot a few girls were in front of my line. One of the coolest POEs I have ever come across. I came in on H1B without any issues and IO gave me 3 yr I-94 whereas my wife came in via AP and she got the AOS Parolee I-94 for one year. No questions asked, no documents asked and no paystubs or nothing asked. Not even where do you work and which company.
It was a breeze.
So dont worry and carry on with your regular travel plans but make sure to carry every single document incl. paychecks just in case.

Guys,
What is your plan if IV decides to CHEAT all the contributors for FOIA request? I've decided not to participate in any future initiative by IV if I don't see FOIA information.

Rameshvaid, you are right the Dream act (as it is now) will not cover the legal kids. However, what we are trying to do is raise awareness and get people to gather together in support for including a provision for the legal kids into the bill as an amendment. It could be anything like "also to include children who are beneficiaries of an EB based GC application and have been waiting for more than 5 years and have fullfilled all requirements that are stated for the illegally present kids to be considered for a GC".
But for that to happen, we need to get enough number of people here (particularly people like you who have experienced/ experiencing this problem) and then as a BIG GROUP take action.
Individually calling/faxing might/might not make any effect as Pappu mentioned.
Please let us first gather more people.
to all who post/visit this thread try to also make small comments (without disturbing the discussion) in other threads too about this issue. Not in genuinely serious issues but threads like "who will be the Next Indian PM, what will be CIR be like, What is May bulletin going to look like" etc. These are threads intended to release pent up frustation and primarily for chatting with other people. We could insert comments about this issue in those very politely (Never be rude!! please).
Count me in and let me know if I could be of any help any hsape and form..

I did not come by my own. The company I was working in India had sent me here. I will go back to India if I need to( personally or officially).
senthil1,
So you are saying that "before" you came to US there were not much fake resumes. But after you arrived, number of fake resumes have increased. The only qualifier that highlights the change between the two situations is your coming to US, isn't it? My question to you is, why are creating all these fake resumes? Why did you come and why don't you go back? Maybe that will stop all these fake resumes and rest of us all will be back to our good old days.
