Took an Infopass and visited the local office here in San Diego. Though they were nice and polite...a emergency AP can only be issued if some family member is seriously sick and there need's to a doctor's note to that effect. However, he was willing to raise a SR on the case and added a note on the urgency of the AP and if it can be expedited....not sure if that will do any good. Just waiting and hoping for the best.

Once I selected that, it takes me to the next page that has 4 options.

3. EAD inquiry appointment
4. Case Services follow-up appointment
Looking at the options, I would imagine option - 4 looks more relevant ...But it also says the following.
"If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment."
I have two questions.

I have sent my I-485 on June 1st under EB3 preference since my spouse's EB2 was under retrogression.
Now that everyone is current, I want to file AOS again as his derivative in EB2. (I have no hopes on EB3)
There is a question in I-485 (have you ever applied for AOS before , give date, filing location and final disposition")
Could anyone help me writing the reasonable answer please?

You can take a permission from USCIS to remain absent for a period of upto 2 years. After that you will either lose your GC or you need to go back to consulate in your home country and ask for a permission for reentry.

Media is biased! It speaks only about illegal immigrants. Doesn't include a word about legal visa holders and adjustees, who'll feel the most impact.

Why are you skeptical about everything? Now you are able to file I485 and celebrate and file it. When PD goes back see that time. Some thing is better than nothing. If you get gc you will worry about citizenship.
I am not skeptical about everything, I am happy that everyone can file their I-485 in July. All I am saying is the fact and want to remind people not to bitching around when retrogression hit in couple of months.

Some more light what the quizzing for 1/2 hour was would really help.
The reason he started quizzing:
Did he see the landing paper or did he ask your purpose of visit to Canada ?
Did he ask whether you have started the immigration process in the US ?
I wonder what he must have done against your name/I-94 # in the records since you have already been granted entry.
In what way can he give you issues at the I-140/I-485 stage? was that an empty threat or a seed sown that will grow up into a problem when the I-140/I-485 IO checks your records during adjudication!
I landed in Canada as a PR on Apr 4th. I had to return to the US to finish some stuff before taking a vacation and the experience was unforgettable. At the US border office I was quizzed (more like beat up)for about a half hour. The US officer in charge made a copy of my Canadian Landing paper and said that I can't have residency in 2 countries. He said that he was going to stop my residency process in the US, in spite of the fact that I have not even started the US green card process (Labor certification pending) and had applied for Canadian PR at least a year before my employer applied for my labor cert (changed employers). I thought that he would refuse me entry to the US, but luckily after a lot of pleading that I need to finish things up in US, he gave me entry. I repeatedly asked the officer who gave me the I-94 as to what effect will this have on my 140 and potential 485 to which he replied "Your processing is done. You need to leave or we are going to call the cops"
So all of you guys/girls with AOS pending, beware, these are not good times to land in Canada with a PR. Heck, I've not even started my green card process, yet the guy gave me so much of angst and made the 1/2 hr a living hell for me. This is after I've lived 9 years in the US as a law abiding and tax paying person.
Now I believe those guys who say that POE officers are behaving very badly nowadays, given the economy. They've appointed themselves as "guardians" of the US from "invading foreign hordes" and interpreting the law whichever way they see fit. :mad:

You will be okay. Don't worry too much. Just submit your paper work and relax! I have the same education like you. i.e 10+3(Eng Diploma)+3(B.Tech)+2(M.Eng). My labor called for MS+0. I got my 1-140 approved last year at NSC under EB2.

Hello, one of my friend had recently filed for H1B and needs guidance
Current Status : H1B expired, applied for renewal, converted to Premium processing to be able to renew drivers licence. He got an RFE asking tons of details about the company. The company responded, and was told by the lawyer that he is stuck in background check. He tried to contact a senators office to get the status and was informed by the senators office that USCIS intends to send him an denial notice and the case is with the clerical staff to send the denial, he would hear shortly from his lawyer.
His I-94 has already expired, he has a 140 approved recently and has not yet filed 485.
What are the immediate steps he needs to take to maintain his status in the country.
Any guidance will be highly appreciated.

Lets do a realty check. These rallies are more at the college/university level thinking. We need to act a little mature and professional.
My idea would be:
Who ever can work remotely, plan to work on that day in the lawns of Capitol Hill. Only arrangement needed is wifi access. Company logo attire with black ribbons/flags will make a bigger impact.
With no disrespect to illegals as people, our last rally was perceived as an illegal immigrant rally. If the congressman addressing our rally thinks we are illegals, there is no bigger joke than that. Let�s correct our image!!!
(I won't be able to participate, as we are expecting our first child around that time frame)

That is of course true when you cross international borders .. after all that is the whole point of having visas and passports.The question is can you be stopped at random by a cop and asked for your legal documents the way you can be asked for your driver's license ? If such a law had been enforced there was no way the illegal alien population could have been so high.
When i used to live in MI, by mistake i crossed canada border and ended in US immigration office. The officer asked for my I-94 record and passport. As i was not going out of country , i didn't have my passport with me.
He said H1B holders need to carry passport all the time with them even if they are going to mall.

My friend approached the university people again through one of the professors she knew and they said it's not their policy to provide a custom letter based on my RFE crisis but they can provide a letter outlining the general admission process for the 4 year Bachelor of Engineering degree and in the admission process they will mention
"Lateral Entry to Bachelor of Engineering based on Advanced Standing, applicants can be admitted to the second year of Bachelor of Engineering directly"
Submitting this kind of letter with RFE helps or hurts? Please advise.

When you are working on H1 here instead of india because you can earn better and when you are taking away job from american citizen....how can you argue like this?
I have many reasons for bringing nanny here....
1) I want a person who is making 100 $ per month to earn more (atleast 1000 $ per month ...right??)
2) If she would come here, she can support her family and some day her boy can come here for study or something....
3) I want somebody who understands my culture and the way i want to raise my kid.
4) I can get somebody from new jersy but mostly i would get illegal migrant...which i am not comfortable with.
Apart from my personal reasons, one simple economic rule, if you can get cheap labor, you don't want to spend more....that's why cos hiring you instead of American citizen,and outsourcing working great....
I really like your theory of "husband with cribbing wife", but unfortunately i m the wife, who is working 40+ hrs with fortune 500 company and planning to start her own company, whose husband keeps travelling (consulting) as he cann't change his job until GC.
With all odds working against me, I want peace of mind that my kid is in the safe hand, He is not sent back from certified day care only because he is sick...
And if i tell the story of the femal whom I wants to bring here....you would start crying...:-)....

Do you know that you can get a nanny here in the US for 200-300 bucks a week? Or send your kids to Home day cares? Or efficiently run Church day cares? and even proffesionally run day cares.

google for nanny and you will get nanny matchin service sites. look up on craigslist. post for a 'nanny wanted' at your Indian store. and there are nannies for children with special needs too, no i aint talkin about you.

It is really hard after living in one country for 12-15 years ...(punctuated by about six 1-month visits to the home country) and ..........then to start all over in another country ...even if it is where one grew up as a kid and as a young adult.
I myself have been in this country for 9+ years now. My kid was born here and grew up here. She is 5 years old. My wife has been here for almost 7years.
Now, India is kind of foreign to us.
I do not think going back now is really an easy option for us.
