No doubt the industry lobby is verrrrrrrrry strong. But the AC21 measure also allowed employees to change jobs; not sure if that was entirely in their interests.
In any case, tying our fate to H1B is not a wise thing to do. The house will reject it one more time. They simply don't want the H1B increase. What we saw last year is an increase of only 20K for folks with advanced degrees in spite of the industry lobby working so hard. The industry lobby would have liked many more H1Bs. They don't care for the green cards or the plight of those trapped in the process. I have heard a top exec from a top tech firm say that after they finish their 6 years on H1B, they are welcome to go back! Actually, many prefer it that way. Alterego, you've pointed out correctly that the industry cares for NEW workers.
If anyone is seriously thinking that the industry lobby will (in the lame duck session maybe) sneak in an increase in visa numbers in a bill that asks for more H1B, he/she is in a state of delusion. Had they been that concerned about the issue of retaining employees, they would have asked for higher visa numbes when they lobbied succesfully for an increase in H1B itself during the Clinton years.
IV's is on the right track. It may take time to get them to understand the difference, but it is achievable in a year or two. What is also likely is a temporary increase in visa numbers; this was done some time back, and we should have no problems with that.

Have you even looked into AC21 ? There were almost 250K visa numbers recaptured in that law, that was the whole reason PDs were current until last year. In addition, when the budget bill was passed last year before IV was formed, who do you think tried to add in all those provisions for recapturing visa numbers, excluding spouses from the count and so on? Try to get your facts in order before just posting.

They are simply not as agressively pushing it as it does not address their immediate needs the way H1b quota expansion does. In addition they have come up against a group of people/companies who have learnt how to utilise this whole H1b process in a way perhaps that it was not intended ie body shoppers. However that is for industry to figure out and lobby against if they do not like it............... and dare I say if congress stands firm on the H1b numbers that is precisely what the tech. titans will eventually do to protect their access to foreign talent.

Finally AP got approved after 104 days from NSC.
E filed AP on May 5th
Approved on Aug 17th
received docs on Aug 23rd
well its actually 110 days between may 5th (date of filing and you actually receiving the AP on hand)..

Excellent catch, amoljak. See my post above for the explicit rule re: EB immigrants not being subject to a hard quota. The IV core team is already investigating if Sections 202(a)(3) and 202(a)(5) are equal. The language seems to suggest so, but 202(a)(5) makes it explicit that EB visa requests under a specific EB category (the visas made available under that paragraph) will remain within that category until all visa requests are satisfied. EB1 will not spill over into EB2 unless are ALL EB1 requests are satisfied; ditto for EB2: EB2 will not spill over into EB3 unless ALL EB2 requests are satisfied, and so on. 202(a)(3) says that in general, there is a soft quota for both family-based and EB green cards, but the categories make it confusing and open to interpretation.

A3 is generic to both FB and EB, combained together and it is subject to DOS interpretation. A3 was there in INA before A5 was introduced thro AC21 in year 2000. Therefore, we (IV) needs to understand what was in the mind of the lawmakers to strikeout A5 in both bills. Is it just to avoid duplication or some other intension? It will be good to track this issue with some expert attornies.

Please don't get me wrong. I truely appreciate all the efforts of the core team. My intention in saying what I did was to put the info in a truthful manner as I saw it. And let me the first to say that even if the current senate and house is not able to adress our concerns before its term expires...just by having them pass incomplete bills with our provisions sets a very good precedent for the New congress after Nov elections.

Republicans will focus on Security, including border security, in the month of september. This way they can demonstrate something came ou of all those field hearings...and they can play up security, which traditionally is the strong suit for republicans. And they know that altho democrats want a comprehensive bill, they do not want to look weak on security hence will vote for a border security bill ahead of the elections.
btw, Frist's initial border security bill also included legal immigration relief measures. at that time it was not passed by the senate, but it would pass now given elections are so near. Given the republicans want to accomplish something on border security before the elections, not even the restrictionists would want to sabotage such a bill. Repubs are their best friends on the immigration issue, and they can't strengthen the democrats because that would only hasten "Amnesty". Amnesty for 12-20 million , spanish speaking illegals is the last thing they want. So, my friends, this will be the best vehicle for immigration relief measures and also the last chance for republicans to prove, before the elections, they are not Anti-Immigrant but only Anti-Illegal Immigrant.
Appropriations or other bills would be much more dicey, as the failure of S1932proved last year. Relief measures could be ruled "non germane" or stripped out in a thousand other ways...
If any of our restrictionist friends is reading this, I want to ask yourself "Do you really want to fight Illegal Immigration, or do you want to fight Legal Immigration"? Because if you want to fight both, you ARE definately anti-immigrant, and you dishonor the very legacy upon which this country was built.
