1. They had to post the 485 pending list sooner than they anticipated because USCIS "one up"ped them by posting the info on their website and hence they were not able to play "God" with that info anymore.
2. They got my ID and IP banned but still I came back.

I called all the numbers just now.
I got to talk to all the Democrats aides- who took the message.Some said they are supporting bill and they are getting calling on etc.

In my opinion, Since you have masters they should not even question bachelors degree. How is your LCA filed ? What are col14 and col15 ?
But I am looking to apply logic in a logic free world. I know it is difficult to convince lawyers that don't know, but think they know every thing.
Note: I have seen in the forums some people in situation like you 3year B Tech+ Masters got their 140 under EB2 based on masters. You should be fine.
I am also on the same boat. Mine is 3 years Engg Diploma + 3 Years B.Tech+ M.Tech(Computers) and all are from India. I have 8 years of IT experience and working for well known company. My attorney is saying that my case can not be filed under EB2 because I don't have 4 years Bachelor's degree. Even I have Masters Degree it can not be equated to US Masters degree unless I have 4 years Bachelor's degree. I have tried to explain her that mine is actually 4 Years Bachelor's Engg Gegree, but I completed in 3 years because I was admitted directly into 2 year of my Bachelor's Engineering as I have 3 years Engg Diploma. But no use, she still says not possible .Here is my attorney response ..
"Please note that recent guidance suggests that USCIS will not accept an application for the EB-2 category where the beneficiary has a combination of degrees to show the equivalent of a US Master’s degree. Although your evaluation does indicate that your education is the equivalent of a US Master’s degree, if your Bachelor’s degree was a 3-year program, you may not be eligible to apply in the EB-2 category"
I was shocked after hearing that, I don't know what to do now. Please share your thoughts.

I returned from Mumbai to DC via Frankfurt by Lufthansa, with AP and expired H1 in PP without any issue on June 30th 2010.

Can you confirm that when you travlled to India (i guess via FRK) were you required to show your ATV. I assume that your visa was expired already in your passport.

One of teh pre-requisites for getting ATV is Visa to the destination country i.e US in your case and my case. So how would you get that if you are on AP (unless you have a H1/H4 in your hand, in which case u r probably better of getting teh US visa)?
why does Air India have Newark to Mumbai requiring ATV?. Mumbai to Newark is understandable, but if you are going to India, why do you need an ATV.
Then on the last line they say that passengers will not be allowed in Mumbai, which means that they are talking only about Mumbai to Newark. What nonsense, they don't even know what they are writing.
I am just making sure that I DO NOT need an ATV to go from here, since I do not have time to apply. I will get the ATV from India before I travel.

What is being seen here is an extreme irrational response, which will lead to nothing. Still if people feel that sending flowers will help they should do it (although if anybody feels this will actually change how the USCIS functions, they are either extremely naive or highly delusional)
