Thanks everyone for being patient and supporting us. The work is happening at all ends and it is an uphill task.
We really need to increase our membership. Higher membership will mean us looking tall when we meet lawmakers. Please all try to help us spread the word of IV to everyone you know that is stuck in retrogression. We represent at least half million people but we currently not even have 6 thousand members. Thus we have to bring lot many people into IV. I would encourage everyone to pls. register on this forum instead of being visitors.
Pls try to help us increase our membership in your own capacity, in any way you can. This is something everyone on this forum can help us with.
What is current strenght of IV? I have not seen the number changed or updated for long?...Any update on Membership count as well as funds will be appreciated

Firstly, i would like to thank you for replying to my question. Please find the below email sent by my lawyer today:
As per our conversation, attached are the two lists that you can review.
Starting from November 1st *Onet has changed the positions for software professionals, please find information below according to *Onet http://online.onetcenter.org/
There are no EB2 positions available for the Software professionals, only EB3 positions are available. However as we discussed earlier if the company has a business necessity and are able to produce the documents for the business necessity you can file the case under EB2, which is still beyond the requirement according to Labor Department.

How much money you have donated?
This knee-jerk response to question the questioner is not needed.
Whether he/she has donated or not ...is not important.
Everyone who has contributed towards IV and/or intends to contribute towards IV will ask this question. It is not intended to insult or to question the laborious work done by IV. I am hoping more people realize this.
The answer to your question is that IV will not discuss the details of their expenses in public forums. I am not quite sure if its discussed in the donor forums.
However i think a general idea about what the expenses are is as follows.
These are my guesses : (IV Core please feel free to add/remove items to this list)
Ongoing Expenses: Maintaining this website, phone for IV, paying for reputed lobbying consultants, paying for attorneys to pursue important issues in court.
Advocacy Events: renting out hotel suites, possibly paying for lawmakers expenses to attend, advocacy packets for lawmakers, helping members with expenses to fly to DC and meet lawmakers, other miscellaneous expenses stationary/food etc
Please understand that this is an all volunteer based organization and there are no absolutely defined positions/roles played out by members. Members join and help out in areas where help is needed.

The benefits to the porting are obvious. However let me share with you the considerations:
1) You have to change jobs presumably on another H1b visa in order to do so. There is inherently a risk in this when you do not have a green card. You'd certainly be a brave soul to change jobs on an EAD based on your EB3 petition while trying for an EB2 petition. How would you justify the same/similar requirement?
2) PERM labor certification is not going to be what it was previously given the current oversight.
3) Ported cases will definitely get more scrutiny (and probably more RFEs) from the USCIS.
4) Premium processing of 140 petitions is for a narrow subset of 140 filers who need to extend their H1b visas, failing which you are likely to take well over a year to get you 140 approved and therefore your PD ported.
5) Political calculations and the elections will be over by later this year, there will definitely be the impetus to address immigration as an urgent issue in the new political cycle and there will likely be a solution. If you are at the 485 stage, with a retrogressed PD as your only issue then you have one problem, if you are at an earlier stage then you may not be approvable at the stage when they are "generous".
If even after all this you feel your best chances are with EB2 then you should go ahead.
Good luck.

Did you get an answer to this ? I am planning to move to Connecticut and will be working in New York City, thus wanted to know if you got an answer to this question.
NYC is pretty easy, you have to shown your passaport and you get your ID or Licensing driver application. Thank god, but what a mess! I am wondering if we are still welcome in this country, i don`t know any more....

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.
Cant beleive you said that ! Just think how it feels to be waiting for receipt notices, knowing people who filed in late June are still getting them (and only a couple of July 2nd filers so far)and also knowing that if something is wrong with ur application, its going to take years before you can apply again....and compare it to the additional 2 months u r going to wait for ur EAD/AP
Thanks

Truly a tragic incident. There is no excuse, what so ever, to take someones life and to commit suicide. No matter what the hardship, it has to be faced and move forward. Indians are too emotional and take it so personal and worry more about what others think.

I am little confused here, do they take into account the reciept date or Notice Date ?.
My Application was sent on July 2, and ack on July2, however the application got transferred to Nebrska, CA and back to Nebraska, and I am told the Notice Date is Aug 30. (If I go to Online website it says On Aug 30 we recd your appln like that) But I am July 2 filer.
So if I want to move, should I think i am safe after 180 days which is jan 3 or is it March ?
It's the received date as specified in the receipt (i.e. jan 3).

If it was EB2, you have better chance of winning lotto than get EB2 approved with 3 year degree. I had 3yrs + PG Diploma + 6 Years of Indian Experience + 13 Years of US experience and I was never able to cross the labor certification hurdle. BTW, I tried 2 times.
There is a little chance if you had 3+2 years degree and the labor was looking for Bachelors and would accept equalent foreign degree as evaluated by reputed firm. I believe your diploma was the hurdle.

Hello -
As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....
ANY SUGGESTIONS FROM ANYONE WILL BE HIGHLY APPRECIATED. Murali please respond with any possibility which I can explore upon.
Thanks
Get an affidavit from relatives who were present for weeding....2 affidavits will be enough. No need to travel abroad.

Sbind,
I am also in the same situation, My (including my wife) I-485 case was approved on 8/5, my wife received physical card 2 weeks after and I received a FP notice (Code 2) and i gave my biometrics on 9/29 and my I-485 status changed from Approved to Initial Review on the same day. Its scared me and i immediately called USCIS to know whats happenning and have created an SR...so far no response yet. I have my approval notice, as you suggested i will take an INFO pass and get it stamped on my passport.
Please update your case in this thread.
Thank you

[QUOTE=sammas;1967354]Probably the RFE might be related to photos not being sent. A friend of mine received a RFE for not sending the photos eventhough they are not required to be sent but he did not get any Biometrics notice. [QUOTE=sammas;1967354]
Sammas, May be it was lost in the mail, so your friend did not receive and the USCIS issued an RFE.

Hi,
My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.
* Can I claim them as dependants on my tax return?
* Has anybody done this successfuly before?
* What is the deduction amount per person/dependant?
* What is the process? I know they will need an ITIN etc.
Regards
Nick
Yes, You can certainly do that. If it would have been Year 2000 it was very simple but now in year 2007 it's bit tedious. I am Trying to explain as under. And this is not a legal advice just an opinion.
Rule:
-----
More than 180 days stay in USA (You will have to prove that) is a MUST condition for getting ITIN. The key is more than 180 days. It does not tell that stay should be continuous.
How to do it?
------------
1) Have US MULTIPLE ENTRY Visitor visa, generally 6 months visa are
granted. But that is 180 days not more than 180 days. No Problem.. Go to
step 2
2) During first stay of 6 months of stay in USA, get Canadian Vistor visa and
send your parents to Canada on the day before the last day of the
first stay.
3) After some days invite your parents back to USA. This will most probably a
another 6 month grant.
4) Do not call IRS for applying ITIN
5) Search for the bank in your area which requires and processes ITIN
application directly with IRS for the application of opening checking/savings
bank account for the people who do not have social security number. Every state and major city has such kind of
banks. Your regular bank may not be autorized by IRS to apply for ITIN on behalf of its
customer.
6) Go to that bank and tell the manager to open a checking account for
Visitor visa holder and from that point onwards bank will take care of.
7) Wait for 15 to 20 days and you will have your Parents ITINs mailed to you.
8) And in next return you will be able to claim them as dependent.
Note: Guys who did in year 2000 around did not have to take this tedious route. So you mayl get both kind of opinions in this forum. If somebody says just apply to IRS tehn that guy probably might have done it in at least 4 years back. But nowadays you may have to do as I worte. Take the advise from your CPA.
