I agree with you Shukla. Complaining people should understand that IV coremembers common people like everybody like us. They dont have any powerful contacts or back channels to Capitoll Hill or wherever political decisions are ironed out. The difference between Coremembers and complaining members are that, Core Members are sacrificing a lot personal time and money on behalf of all of us who are in this shit.

Guys,
This bill will not affect any of the US High tech companies nor high-skilled immigration (it has nothing to do with EB immigration).
Even big companies like Microsoft and Intel would not be affected by this bill (it is not as restrictive as the previous rule that firms that receive TARP funds could not hire H1Bs).
No need to fear that this would be the start of something bad that we have to fight this to prevent future anti-immigration bills. No such implication.
Although this bill borderlines indirect protectionism and interferes in the free-market principles, it is promoted to prevent fraud and may be to decelerate outsourcing by mostly Indian companies, given the current rate of unemployment at 9.5% and the increasing threat of widespread deflation.
To be clear, I am not in support of this bill, but it would be a sheer waste IV's resources to fight this bill. If some guys can attach these kind of bills to other legislation, may be IV should focus on passing the visa recapture and may be increasing the per-country limit from ~7% to 20% (eliminating per-country limit being the most-desirable).
Instead of fighting this bill, the least that IV could do is to focus its resources to eliminate the freaking diversity lottery program and allocate the 50K green card visa to the EB program. In this 21st century, there is no more need for diversity (which is line with the spirit of the past US Supreme Court rulings), everything is already globalized and flattened. Everything should be based on pure merit -- which is the American dream anyway.

I remember he mentioned on his show that the government could not even issue passports timely to the citizens. Maybe he would be interested in knowing how those agencies screwed everything up for the legal immigrants. Have you thought about that? If he could mention the whole chaos on his show, I am sure a lot of people will have a better understanding about the difficult situations we are facing. That would be great. :cool:

AP got approved today around 7:45am PDT. I had logged in earlier in the morning and status was still "Initial Review", refreshed it a few mins later while working on something else - lo and behold the LUD date had changed to 11/18 and case status had changed to document production or Oath Ceremony....so now I can travel on 11/28.

I am in a similar boat as my AP petition was approved on 11/16 and the status was changed to, 'Document Production or Oath Ceremony". It has been 15 days since the status got changed online, but I am yet to receive the physical AP document on hand.
Could you please update whether you received the physical AP document before your travel out of the country on 11/28?

There is no need for this. Actually, universities in Michigan has already sent out emails to their students notifying this change.
In my view, sombody should forward the links to University of Michigan and Michigan State University's international students and scholars office. May be CMU, WMU, Wayne State as well, and their engineering programs and business schools.
They should know as they will be hit.

Are the democrats shying away from passing any immigration related law? If we are to go by all the newspaper reports on this topic and the democrats' muted post-election stand on immigration and the absence of any immigration related topic in the first 100 days agenda declared by democrats ; it definitely seems like they have their heads in the sand.

Although the President and the Dems said immediately after the elections that the immigration issue is one on which they see eye to eye, everyone has been quiet lately with regards to immigration. Things better happen in the lame duck session. The industry is also waiting for action in the lame duck session. If it doesn't see that, it is going to do some massive outsourcing. So let's hope something happens in the lame duck session.
BTW, those in NY please please send a PM to bottlemani. Guys if we don't do something now, we may have to wait until 2008. We can't expect the core team of IV to do everything. We should ourselves attempt to go and meet lawmakers in person. This, I mean actually showing up in lawmakers' offices, will make a big difference to the core team's efforts.

They of course have to apply in the same way anyone would and have to find a way to pay the tuition fees and board if applicable. It might be more difficult in some locations than others to get in state fees without a green card but you have to work on that matter with the institution in question. One more thing without green card in hand you are not entitled to any federal assistance, student loans etc. Majority of scholarships require green card too.
So what you are saying is that kids (<21 or >21 years) who are in I-485 status can go to college with the same status....work with institutions if they have any issues .. financial sorta.. but should not be having any legal status issues. understand.
But what is this aged out issue we are talking about here??? I do not understand...any pointers... I am sorry...I do not know full details for this criteria.

IMHO dont even bother reading the USCIS memo or whatever it is. The article on R&A website says this memo from USCIS has been protested since June 2009 by Lawyers. Assuming they are correct for a moment, AILA guys would've notified the companies employing folks on EAD that they are employing illegal immigrants!! No lawyer has done that yet :)
Secondly wouldnt this memo go against the AC21 portability? Isnt the AC21 S. 2045, the American Competitiveness in the 21st Century Act - H-1B Visa (http://usavisanow.com/h1bs2045sum.html) a law introduced by the US congress? Since when did USCIS overrule US Congress and become lawmakers themselves? They are supposed to implement laws made by the US Congress.

No Gurantee that lobbying will always get 100% success. You need to analyse the problem. Affected people are only Indians and Chinese. Rest of the world does not have any issue. Is there any impact on any company because of you waiting for green card? Or is there any impact for country because of you waiting for the green card for 10 years? My answer is it is very little but many companies are getting advantage because you will work hard for the same company.

They think that they can stay as long as they want using AC 21. Even if you get 500K IV members and millions of money timing and Strategy is important for lobbying. There are any of 3 situations you can try for EB immigration reform. 1. Wait till economy improves to expand EB immigration 2. Wait till CIR comes and attach the EB immigration 3. Accept some compromised version of Durbin/Grassley H1b reform bill with inclusion of EB immigration if that comes to consideration. I am sure that 90% of IV members will not accept the third option because many of them fear that they may be impacted by H1b reform bill. And also I do not think any pro immigration or anti immigration bill will be taken up before CIR.
So it is grim situation if you see for next 6 months but it could change after that. I doubt it will make any difference in strategy even if you make a major change in Core Team. Generally in any non profit organisations major changes are hardly happen. But additions usually happens.About lawsuits generally lawyers will decide viablity of lawsuits and success probablity before going for it. Do you have an old AP that is valid till Sept 19,2010. If then you are good. The IO has done it right. If you apply for renewal, then they will extend from the expiry of the old one. This was the case for me last 3 times, but this time, the approved on July 11 and made it valid one year from approval date and I lost couple months due to this.
