Now that USCIS and DHS realized the moster coming on their head down the line in the name of GC / EAD / AP and they have maintained the lie with dis-honesty all these years that they could not process 485s because of the lack of resource, they have fallen flat on US Congress to bail them out. Whatever solutions they have had in their disposal all these years they are taking them out and discussing with congress. If they wanted to be really helpful to the highly skilled immigrants, they should have done this long back. All these days they all were anti-immigrants and the ex-director of USCIS was a active member of anti-immigrant community.

As everyone pointed out there are lot of things in favor of the employers, Attoreys & USCIS when I 140 is revoked. The only thing that comes to our rescue is AC 21 when followed as per the guideline which is currently not being done.
Guys, Please support the IV AC 21 Campaign and let us help ourselves..
Though there is no charge to revoke I-140 from CIS, corporate lawyers do charge money and that makes it in their interest to convince & pursue HR ppl to do so.:(

We have 8000+ members but only 200+ contributed. I have been thinking about it and here is one possible answer. If you look at the poll result about whether we should push for 485 or not, there are about 280 guys supporting this goal. Maybe almost all recurring contributions are from this group. :confused:

Hi,
I am in bit of a situation and trying to sort my options. I got my EAD, last month. Also took care of finger printing and received AP documents also. I 485 was filed in July 07. My I-140 is not yet approved.I am accepted to school in france for one year business course, starting Jan and ending Dec 08. Max I can fly back few times from France to US, for few days (In case there is rule for not staying abroad for more than six months). Plea
I am planning to either
a) Submitmy resignation and leave US by end of Nov 07 OR
b) take Leave of Absence from my firm for 15 months.
Is there a way I can continue my GC processing, factoring that I will be out of states for whole of next year.
Your suggestions are sincerely appreciated

This is a good question and let me give you a straight answer which others on this forum will not tell you. I am not sure if this is a rhetorical question or if this question is asked out of curiosity. But here are two versions of the answer to this question, so please bear with me here as I try to explain both versions.

High skilled educated "illiterates" thinks that EAD is like green card. In July 2007 when everyone filed EADs, everyone thought that now they will get green card before the expiry of their EADs. So based on that foolish assumption, these poor illiterate folks started thinking that EAD=green card. Now the reality is setting in, and now these poor illiterate high-skilled folks have been stuck by reality check. So the real answer to EAD=green card question is setting in. And that version is -
Real Version
EAD is nothing like green card. EAD is a benefit of pending I-485 adjustment of status application. These is a good chance that green card application could be rejected for countless number of reasons resulting in loss of EAD privileges. As the economy worsens, this reality will set in further.

Ok I think we are reaching new heights of RIDICULOUS here. An IV member has asked a SIMPLE question about whether or not an Indian citizen needs a visa for the Bahamas.
Who the heck do we think we are to ask him/her to NOT go on that cruise and instead donate to IV?? People i know that we need to raise money and quickly, but this is really not the way to go about it. Everyone needs a vacation to recharge their batteries and spend quality time with their families. The GC is a "MEANS to the END", NOT "The END". Going by this logic, lets not do anything for the next 2-3 years. Lets not buy houses, cars, furniture etc. Lets instead contribute to IV. Besides what is to say that this person has not contributed to IV already?

While it is possible to claim parents on B2 Visa as dependent, after they pass presence test, they have to include their world-wide income in the tax return.
IRS don't have time to chase, if world-wide income of parents are not reported. For that matter, many people get away without their own world-wide income. It may be risky, there was news in Indian News Papers, that now IRS has started tracking investments done in India.
But anyways, whatever I know, it is possible to claim parents on B2 Visa as dependent, after they pass presence test. They can get ITIN.

Hello friends,
Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).
However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.
Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

Completely agreee with hari_baby22. Couple of days back I posted that immigration voice could get a lot more donations if they publish there earnings/expenses report online and make everything transparent. As in my birth certificate my mother's last name was not mentioned , I have just obtained an affidavit from my parents(together) using one of the samples floating around. But I just found that there is spelling mistake in my father's first name in one sentence. But in other sentences, its correctly wriiten.

I would go with the prediction in the Jan 2010 Visa Bulletin:

India: February through early March 2005.........ONE MONTH BEHIND HERE....NOT BAD WITH THE PREDICTION
If Section 202(a)(5)were to apply:
China and India: October through December 2005 ..................THIS IS THE SPILLOVER CHANCES FOR JULY-SEPT 2010....MOST LIKELY IT WILL CLOSE AT JAN 1, 2006
I tend to agree with you. Projections by DOS seems to be closer to reality.
I would stay conservative contrary to many other predictions.
1) China moving to Nov 2005 is a good thing for India. This means India will get all the remaining fall-down/fall-across numbers until priority date reaches Nov 2005. After that both India and China will share and move the dates by a month or so. This should get India to Dec 2005 to Jan 2006.
2) Many see the dates have not moved much for so many months. So they can be skeptical about the date movements in the last few months. The reason why i anticipate much larger movements in the final months is due to the fact that India gets about 3 times more visas through fall-across/fall-down than what is alloted for just India.
